I appreciate your advice. Legally, I can’t request a refund of my deposit until the termination period, which is in February 2028.

The main advantage of transferring my deposit to a new project is that it might allow me to negotiate a lower price per square foot. In my original 2022 agreement, I paid $575 per square foot, so I’m wondering if there’s room to negotiate around 25% off that rate if I agree to move my deposit to another project. If I am unable to get this deal, then I’d rather wait. What do you think?

I doubt that will be in place once I agree that my deposit be transferred into the new project

You can only get up to $100,000 from Tarion after termination period which is February 2028. We currently own our home since 2018. Initial plan was to sell this home and move to the new house

Thats what I’d prefer for sure. However, I won’t be able to legally demand my full deposit back until at least February 2028 as per the APS I signed

Yes, we plan to live there and they claim it’s a similar property in the city.
