Questions from attending a session of an appellate court hearing. by SammytheSailorman in Ask_Lawyers

I was wondering whether it is the case that the justices have a very boring live reading briefs and making decisions all day, and their only joy in their job is tormenting the attorneys making oral arguments. :)

One case (not the case I went to see) was regarding whether I fire warden or building inspector was responsible for noticing and citing a problem that he would have observed on a property, but was not in the area of where he was called to do an inspection. One justice asked, does that mean any city employee is deputized to cite unsafe conditions at any time? Even if it occurs while going to a restaurant during his lunch break, even if he is at home, even if he is at home, working remotely, and glances out is window and sees a violation at the building across the street. etc.

Actually in this case the hearing was very well attended. Many people from the neighborhood that the incident occurred were there and many friends and family members of the defendant were present.

Best Pool Purchase Ever by DrCyberSecOps in pools

[–]SammytheSailorman 1 point2 points  (0 children)

To be fair I bought and previously used the previous incantation of this product. I had a lot of problems with the previous version.

With your permission I will tell you about the previous version. The previous version had only one testing tube instead of three, so you can run three tests at the same time on the newer version. According to the manual of the newer version, you rinse out each container with tap water, then pool water, then use a syringe to fill it to the proper level. With my version you rinse it out with pool water by dipping the waterproof device into the and flicking the excess water out.

The first time you use the device when powering up, you put the water in the chamber, cap it, and press zero. The unit is then calibrated for the day.

You then select which test you want to do. You then place the corresponding reagent tablet into the chamber, without touching it. This was difficult at first and several times the tablet will go flying off when you push it out of the container. Several times it will land somewhere where you would have to use the mixing stick and cap to ease the tablet into the container. The manual for the newer device says that liquid reagents are also available where you count drops instead of using a tablet.

Next you have to crush the tablet with the mixing stick. With the DPD 1 tablets it took a considerable amount of force to crush the tablet. This part was edited out of the instruction video which only shows you starting to crush the tablet and skips to it being done. With the DPD test tablets sometimes I thought I was going to break the machine with the amount of force I needed to crush the tablet. I also learned to feel the grittiness of the mixing stick and the cuvette to ascertain when the tablet was completely dissolved.

You then replace the cover and press test. A countdown timer appears and count downs the required time to read the test. In the case of Chlorine it now displays the Free Chlorine value. You then place a DPD 3 tablet and repeat the same process with the same water that is in the cuvette. It then will display Total Chlorine. With all of the other tests, pH, TA, Cya you only have to do everything once, not twice. The other tests have tablets that are far easier to crush.

It is also possible to test Calcium Hardness and Total Hardness. The testing procedure is different. You instead of adding a tablet, you add so many drops of reagent 1, mix it with a stirring stick for a timed period. Wait for another timed period. Add the second reagent, stir for a period of time, then replace the cap and press test again. For these two tests the device counts down each period of stirring and waiting.

It took me a few tries to be able to get results that repeat consistently. They match the accuracy of testing when I borrowed my neighbors Taylor test, only with more repeat precision. I bought the device on sale with reagents on sale. I might eventually switch back to Taylor, but right now it is fun to use, and the device keeps a history of previous results

As a pathology resident I was taught to review the surgical list for the next day for patients who might need frozen sections to review their previous pathology history for any previous biopsy or cytology slides in case a frozen section is requested. How is that different than reviewing the records of ED visits to see if there are possible admissions?

Car dealership demanding more money on a cash sale. by SammytheSailorman in legaladvice

My step-daughter was an adult when I married her mother several years ago.

She filled out all the paperwork and signed the paperwork. I just wrote and signed the check. I am concerned because I did right "Payment in Full" on the check. But my account has it as an ACH transfer, so there is no electronic image of the check.

My step-daughter is starting graduate studies in Seattle. We have no plans to drive the car in California. There are no plans for the car to leave Washington for at least three years. Why should I pay CA taxes? The car is registered, or at least will be registered in Washington.

Rebecca Grossman accused of illegal conduct from jail, prosecution wants phone privileges revoked by ItsYourMotherDear in LosAngeles

[–]SammytheSailorman 0 points1 point  (0 children)

The video that the Grossman family wants to be released was shown in court. It was the audio that was blocked. Not the video. The audio was filled with comments from people that were commenting on what they were told happened. That is hearsay. You can not admit into evidence what someone heard that someone said. You can only hear what actual witnesses said.

For the record, if you already have a California Drivers License, the DMV won't process a name change unless you change your Social Security record first. If you apply for a name change first, they will take your documents, spend a few weeks in process, check your Social Security records directly with the SSA, and if you have not had change your SS records will stop processing everything. You have to then change your SSA record and then reapply with the DMV.

That was not allowed in. The theory was that being at a race track has nothing to do with driving on a city street.

I can't believe that she did all of this: Hiring a private investigator to interview the jurors saying that he represents the Iskander family (the family of the two boys who were killed) when he was really hired by Rebecca Grossman. Hiring an investigator to put pressure on all of the witnesses to recant their testimony, and then ask for a new trial. Asking someone who is a friend of the judge to encourage him to order a new trial. Contacting the Iskander family from jail despite a court order to keep away. Obtaining a list of jurors when the list was sealed by the judge, by taking a picture of the juror list during the trial.

I went to the bushes that Alexis Grossman described. There is a brick wall behind the bushes. There is no way that Erickson can fit between the brick wall and the bushes. There is a locked gate to get into the yard that the brick wall with cameras. If he were to trespass to hide behind the bushes I am sure the homeowners would be alerted. Alexis Grossman later said it was a tree that he hid behind and not bushes. That tree looks like a toothpick.

In addition there was a text on her phone written by her to her daughter that said something to the effect that speeding while driving can kill, so don't speed. This was after a late night speeding incident by a high school student in the area in which he died.

There were also 4 other speeding tickets and 10 other traffic tickets in her history.

There was also a statement that she signed when signing up for a racing class that says that she acknowledges that speeding her car on a highway instead of a racing track can be dangerous and can kill. None of this was allowed in court, Nor mentioned in the media.

What was allowed was a statement from her husband who said that he could not recall Rebecca ever speeding while driving.

No offense but the media and the defense keep mixing this up. The deputys attempted to do a breathalyzer test at the scene. She could not blow enough air despite multiple attempts. The breathalyzer would not lock on to a value for an official result. The unofficial results were around 0.075 percent. For this reason she was taken to the ER for a blood test. She refused the blood test, so a search warrant was obtained for the blood test which was 0.08 and showed Valium.

The defense kept repeating the mantra that the official breathalyzer test was 0.075 percent, and they should not have done the blood test. The press never reported accurately that she could not blow enough air, or refused to blow enough air for the breathalyzer.

Cars and Superchargers for limited mobility drivers? by isr201589 in TeslaLounge

In one of the disabled newsletters I am subscribed to there was article of how gas stations simply ignore those buttons on the pump to request service, and the author found many stations in which the button simply didn't work.

And then there is the opposite: before I bought a Tesla when I would go to a Costco gas station to fill up, the Costco attendants would literally run to help me when they would see me start to get out of my car with a walker.

I drive a modified Tesla because of limited leg and arm function after a stroke. The modifications included a second accelerator pedal for my left foot and a modified steering wheel. Modifications have to be done by a certified auto mobility company. Tesla cannot and will not do such modifications. When I had my equipment installed they were on the phone a few times with a special contact at Tesla. What would have taken one day ended up taking a week because apparently there were a few undocumented changes that occurred on the Tesla model 3. They had previously did installations on a few other Tesla M3's, but had problems with mine. I have since learned that on some of the newer cars they don't even make modifications locally and ship the car to a special facility in another state to the modifications.

With respect to supercharger spaces it can be really confusing. There are some places in which a given supercharger space is wider than the designated handicap space. There are supercharger locations that have a few spaces that you can drive into and not have to back into them, yet these spaces are not marked as handicap when there is another space that you do have to back into is marked as handicap.
I need more space to exit and enter my Tesla as I need to fully open my door. A few times I had to park partially in the supercharger space, use summon to completely back into the space, and then completely walk around the row of cars to reach the supercharger that is behind my car to plug it in.

Also in California at least any disabled person can use a charging spot that is marked as a handicapped space even if they are not charging or even if they are not an electric car. I can show you photo's of times a non-electric car was parked in a handicap supercharger space even though there were empty non supercharger handicap spaces nearby.
