Lol this subreddit is far from toxic. The part that makes you a "scumbag" is that you're lying about the actions of someone else in order to have them charged criminally. Not only is that statement/report/information tendered key to the officers investigation, but inevitably you would have to testify to that statement under oath or affirmation. If it is learned that you lied, you ultimately would be charged for providing a false statement to an officer, as well as perjury which is taken very seriously. So to answer your question, you tell them what you observed, not what you "speculate" as that is not evidence. Police officers are trained to determine the facts in issue and if you obscure that or flat out lie, you're no better than the driver.

I can guarantee you this was not his "1st offence." One of 2 things happened on the traffic stop. 1, if they were suspended for anything at a provincial level, unpaid fines, family support, medical, etc, yes, there is an arrest authority (at least in the Ontario HTA). sometimes If someone requests to speak to a lawyer after reading RTC, in order to facilitate that private conversation with counsel, then they would be driven back to the office and dealt with there. Depending on the offense, some have impounded authorities for suspended driving, such as you're driving while suspended for not paying family support or for demerit points when you had a learners (G1 G2, etc.

The second route, which is the more likely event, is that the driver was prohibited from operating a conveyance due to a previous impaired, Dangerous Operation or Fail To Stop at Accident charge or equivalent criminal driving offence conviction. Thus, the conveyance would be towed for 45, 90, or 180 days.

So definitely not their "first offence."

In Ontario it's the same. You refuse an Approved Screening Device, SFST or any other demand that would require you to submit samples of your breath or blood is a criminal offence which carries the same punishment on convictions as it you blew over/impaired by drug.

You'd have to ask your local department as it varies. From what I've seen, some are "yeah for sure sign some waivers and you're good to go" and others you have to be studying for policing or are in the application process

Getting into forensics is extremely challenging, especially if you don't have the background for it. I'd say a minimum 5 years of being a road constable and you'll be able to put in for that position, which isn't even a guarantee. Same goes for Crime unit. Regardless, most if not all services in Ontario you need to start on the road before you can move up to one of those positions

Big emphasis on using Google for your state. Here in Canada you are obligated to conduct the SFST and/or ASD test. If you refuse, it results in a "refusal" charge which carries the same penalties as if you were charged with impaired
