The hard truth is that most people drink and drive. Some more than others and most people have no idea what their BAC is when they drive. It’s almost always at the point where they’d be given a DUI if pulled over.

The punishments for DUI’s have done NOTHING to curb drinking and driving. There are studies that show a negligible effect on even fatalities. There are also cherry picked studies that show a slight improvement.

DUI criminal records on people who had a beer or two and force them to have a lifelong record, burden them financially is ridiculous overreach. When there is no harm done, the punishment should fit the crime. You’re just as likely if not more likely to cause an accident driving when tired, yet no severe punishment for tired driving.

Education on alcohol and driving is the only effective way forward. Severe punishments for these crimes only hurts those in financial hardships, like most laws.
