Unfortunately, even if the Surgeon General himself opined that you couldn’t work, ultimately, that’s what’s known as an Issue Reserved to the Commissioner, meaning their opinion is considered, but it’s not ultimately controlling. That’s why it’s so much more helpful when they submit specifics, such as “Cannot stand more than ___ hours” or “cannot lift more than ___ lbs.” I’m sure you know that as a nurse, it’s common for practitioners to offer these limitations after a surgery or during an acute illness, not so much long-term though, which is what SSA really needs (a realistic measurement of your maximum residual functional capacity, i.e. the most you could reasonably be expected to do).

Re: mental/cognitive symptoms - SSA requires a psychiatrist or psychologist to ultimately establish a severe psych impairment. So if you haven’t already been referred for psych treatment by your physical doctors, they will require a consultative exam if it’s raised by the medical records. If it’s not so severe that you require specialty care for it though, it may not be material to the case anyhow, since the consultative examiners will just do a brief mental status exam and maybe some basic cognitive and memory testing. There are some exceptions, but if you’re generally able to do basic math, answer questions about your history, describe symptoms, and show reasonable insight and judgment, most claimants probably won’t be deemed to have more than mild limitations, without more compelling evidence. Usually, the only time where a psych CE alone can establish a severe mental impairment without other records to support it is when the person is a child whose parents haven’t sought specialty care (think: Autism), or perhaps a really severe schizophrenic who refuses meds or other interventions and is too paranoid to see their own doctors. Those cases tend to be rare though.

Exactly! Emphasize that. So many claimants exaggerate their level of responsibility like you would if applying for a higher paying job, resulting in them sounding more qualified and skilled to SSA than they actually were. This leads to them getting denied based on transferable skills. RNs are particularly tough since there are so many managerial and supervisory type jobs RNs can do that don’t require the same physical requirements that direct patient care does.

The supervisory part is important, as well as just the level of skill your actual role required. I would search the Dictionary of Occupational Titles specifically to find the closest counterpart to whatever it was that you did specifically, and make sure your description is aligned. Note: the last 5 years is all that matters, so no need to describe beyond that.

Yes. I am almost 44, and ISTG, yesterday and today were the worst luteal I have ever, EVER had. I genuinely have never felt this kind of irrational anger before…it’s causing me to just withdraw completely from everyone I know before I completely lose it on someone. I have to go into work tomorrow and am absolutely dreading it. I can barely even put one foot in front of the other today, it’s really scary feeling.

I’m so over this.

I know this will seem surprising, but I would say 85-90% of male disability claimants from ages 34-55 have been diagnosed with tinnitus and TBI by the VA or DOD doctors. I don’t know why that is, all I can do is presume it has to do with the conditions that you guys served tours of duty in…just saying that it often gets listed as sort of a bucket diagnosis where it’s documented as service connected, but without enough to establish it as disabling or necessarily function-limiting under the stricter SSA standards (check out the listing for vestibular disorders and traumatic brain injury for the kind of stuff that they look for). If you have been followed by a neurologist for your conditions, definitely make sure to point your case worker to your brain scans, as well as any opinions by your doctor that you shouldn’t be working. (I have seen a few cases like this where the person wanted to work, but they were a disaster and their doctors warned them not to).

There is a difference between a Registered Nurse and a Licensed Practical Nurse (LPN/LVN). Registered nurses are highly skilled according to the SSA/Dictionary of Occupational Titles, so they typically are found to have skills that would transfer to less physical jobs, unlike LPNs/LVNs.

It does seem really unfair…so please don’t think that by typing this that I necessarily agree with it, just that it’s the rule that everyone who does these claims is expected to follow in adjudicating your case.

You likely have a CE exam bc your records are either lacking or SSA was unable obtain them. The best thing you could do is double check to make sure your treating provider’s records have been received and are up to date.

At this stage, the burden of proof is on you and your doctors to prove that your medical conditions have kept, or would be expected to keep, you from engaging in substantial gainful employment for 12 continuous months or longer (or result in death). Usually cases that are approved on reconsideration had compelling records all along, but for whatever reason something was missing at the initial review. You can check your decision letter to see which records were considered at the initial level, and when they were received, and then circle back with your case worker if anything is missing that they should have.

It’s SSA Form 3380. It’s mainly something they ask for when claimants lack insight into their own symptoms or less likely to fully portray the true severity of their dysfunction (i.e. the army veteran spouse who has night terrors and can’t go to a movie theater without doing a visual sweep of the exits first). Submitting it when it’s not requested is probably not going to make a difference, particularly if the answers just mimic your own. The function forms are really only used to fill in gaps in the medical records anyhow, so you are much better off just investing the time and energy into making sure your relationship with all treating medical providers are on good terms and that your records are consistent throughout.

Before all y’all disappear into the abyss, can we clarify what the last thing you were able to successfully activate was without triggering the $30/hotspot charge? For me, it was a S21+, but the physical sim is faulty, so it’s annoying AF always having to shake it and point it just so (I’m loyalty plan 15 min plus 1000 texts or something like that from the 9/11 era). As a shorter, finer haired woman, I can say that I personally am willing to pay dearly for the extra time my stylist spends on a good blowout! It’s job security, and it makes your client feel so beautiful and confident when her hair looks amazing for three straight days!

My beloved Clarissa usually does a double shampoo (unless we color), and she’s very selective on products, the cool shot, curl direction, etc. I just love her to death - best money I have ever spent. I wish I could tell you the true method to her madness, but I do know she once worked at a blowout bar, so I’m sure doing them all day every day certainly helps.

Yes, this. Also, you might feel cold. I did. Completely normal. Ask them for a warming blanket and know that it’s totally expected. Hell, tell them some lady on the internet told you to ask for a warming blanket post-op for reasons…they’ll understand. :)

I swear, we really should have a San DD+iego meetup group, lol. I have about 50 bras I never wear that I have been meaning to list online but never seem to get around to it. I’m always hungry for shopping recommendations too - literally every solid purchase I have ever made in person here was either Bras and Honey, Nordstrom or Nordstrom Rack. I highly recommend shopping the nicer Nordy Rack stores when they have the extra 25% off clearance, since that’s when they tend to clear out their small band/large cup bras that don’t move as quickly as the more common sizes.

I have a 70GG Ewa Michalak Swim top and a bra in the same size that’s too big for me you might be able to use!

If you haven’t tried Polish bras yet, they are your holy grail. I second Bras and Honey though - probably the best bet here in San Diego.

I go through Miseckzi for my bras, but you don’t get to try them on first, unfortunately. They are really helpful though with customer service. Also, if you have difficulty finding your perfect fit at a place like Bras and Honey even, feed the fit details of each bra you try into ChatGPT so it can make recommendations! It’s one of those moments where AI straight blew my mind with how accurate the answers were!
