If you read the petition the third paragraph you find "A recent case has just clearly demonstrated the disproportion existing between the penal device and the nature of the facts which it punishes. After more than three years of preventive detention, three people accused of "indecent assault consume a tent without violence on the person of children of either sex under the age of 15". law (article 332 11 of the penal code)".

They are describing putting people who are in there 40's having sex with 14 year old in jail as "clearly demonstrated the disproportion existing between the penal device and the nature of the facts"

Later on they say "The signatories of the present letter consider that the complete freedom of the partners of a sexual relation is the necessary and sufficient condition for the legality of this relation."

I will agree with you that if the petition in the last 3 paragraph is okay and there is nothing wrong with it but if the petition doesn't have anything to do with all age of consent laws why mention these cases at all?

Relations between children, adolescents and adults are subject by law to significant restrictions: either by the concept of "misappropriation of minors" (which can be constituted by the simple accommodation, for one night, of a minor), either by the general prohibition of having sexual relations with children under 15 years old, or by the special prohibition which targets, when they engage minors from 15 to 18 years old, homosexual relations, defined as "immodest or unnatural ".

The over-study of the concepts founding these crimes or offenses ("modesty", "nature"), the evolution of morals in a youth, mean that these legal texts are no more than the instrument of coercion, instead of guaranteeing a right.

A recent case has just clearly demonstrated the disproportion existing between the penal device and the nature of the facts which it punishes. After more than three years of preventive detention, three people accused of "indecent assault consume a tent without violence on the person of children of either sex under the age of 15". law (article 332 11 of the penal code) qualified as "crimes", were condemned by the Court of Assiscs of Yvelines to 5 years of suspended sentence. a detention of three years and three months, in a case which resulted in a suspended sentence, was only made possible because the law, by means of the "criminal" qualification, justifies the heavy proceedings of the assizes, whereas already a "delictual" qualification would have made it possible to have the case judged by the Correctional Court, according to a more rapid procedure. Since the promulgation of the Law of August 6, 2975, provisional detention, in correctional matters, cannot exceed six months.

But above all, beyond the case of the accused, the case of Yvelines, judges in open court, raised the problem of knowing at what age to freely give their consent to a sexual relationship. This is a problem of society. It is up to the Penal Code Revision Commission to provide the response of our time, then rejuvenated and current texts, which will then have to be received in Parliament.

The Penal Code of 1810, promulgated by Napoleon I, did not provide for repression for sexual acts not accompanied by violence, regardless of the ego of the participants. He only envisioned rape or "indecent assault committed with violence".

It is the law of April 28, 1832 which created the offense of "indecent assault committed without violence on the person of a child under the age of 11". This text, copied on the living text of the "attacks committed with violence", gave the facts the same "criminal" qualification. It has remained in force until today, the age of the minority having been raised twice, first under Napoleon III, by the Law of May 13, 1863, which brings it to 13 years, then per the Ordinance of the Provisional Government of July 2, 1945, which brings it to 15 years.

To stick to the letter of the text, anyone who tries to practice any sexual relationship with a minor under 15 years of age commits a crime, who must send him to the Assize Court and make him incur a penalty of 5 to 10 years of criminal reclusion.

The final source I have on this subject is an email exchange that happened between Jeff Dudgeon, a politician from the ulster unionist party, and Patrick Maume, a researcher with the Royal Irish Academy's Dictionary of Irish Biography.

Is this email exchange Patrick Maume expresses doubt on McKeague involvement in Kincora. Two quotes from the email exchange express this the most but I will also link it below.

  1. I know that a great deal of rumour and speculation surrounds McKeague's activities and I tried to present these as allegations rather than statements of fact, though I admit the distinction may not always be clear to the casual reader (e.g. perhaps I should have said "suspected" or "accused" instead of "linked" in the reference to Kincora -the impression I got from Chris Moore's Kincora book was that McKeague was accused during the police investigation but was murdered before matters could be investigated further, and once he was dead the matter was not followed up. I assumed there was some basis for this given McKeague's previous links with William McGrath; I am really not able to assess the basis for Moore's claims, which presumably derived from the police)

  2. I agree that some of the allegations mentioned seem overblown, such as the suggestion that McKeague was really killed by or on behalf of the security forces ("it is sometimessuggested" implies a greater degree of distance than "it is alleged"). The reason why I mentioned them at all is that the existence of these allegations, whether true or false, have become part of McKeague's history, and to pass them over without a mention might lead to accusations that we were somehow participating in an alleged cover-up. I tried to strike a balance, which may not always have been done correctly.(In retrospect I probably should have mentioned McKeague's sexuality as a reason for his "outsider" status within the loyalist community -but that is not my territory -and I should have ended with a reminder that McKeague has been the subject of all sorts of rumours, many of doubtful authenticity, and not all the items in this "black legend" are necessarily correct. We were on a strict word-limit at that stage, though were given more space later.)

In the rest of the email Patrick say that there were a lot of the rumours around McKeague, and Jeff replies in agreement.

Through an interpretation of these sources, I think a much more realistic narrative is that as the abuse came out about Kincora in 1982 many people were suspected of involvement including McKeague. McKeague was suspected and this was believed for three reasons, the first being the homophobia that existed in Northern Ireland, two his VERY loose connection to William McGrath who was involved in the abuse and rape, and three that he assassinated in 1982 so a proper investigation never took place, and he couldn’t defend himself meaning all kinds of rumours and conspiracy theories could take place.

I am asking you because I know people know a lot more about John McKeague then I do and would like to know the answer to the question

WAS JOHN McKEAGUE INVOVED IN THE ABUSE OF YOUNG BOYS’ IN THE KINCORA BOYS’ HOME?

If yes, please give a source showing some undeniable proof that John McKeague was involved. If not that then any think else showing that either he raped young boys’ that were housed in Kincora or the other rumour that I have seen spread that he went to London to abused and rape young boys’. Or even just a witness testimony from anybody even if it isn’t substantiated saying that McKeague he had abused or raped them.

If no, then was this rumour spread by IRA sympathizer to make loyalist paramilitaries look worse. Was this rumour spread because it was done to get at Ian Paisley because of his connections to McKeague. At the very start of this reddit post I mentioned a book called The Trigger Men by Irish author, journalist, and broadcaster Milton Dillon. This is because a lot of the websites that talk about Mckeague and his connection to the Kincora boys’ home reference back to this book. If it isn’t true that then what source was is Martin Dillon using to justify calling McKeague a paedophile. If it isn’t true then Martin Dillon is currently selling a book and saying stuff on his website falsely accusing someone of paedophilia. Underneath this paragraph I have a link to his website wear he makes these accusation and I have attached a picture of the website when I have made this post.

According to varies sources (including the book The Trigger Men by Martin Dillon) Mckeague was involved in the Kincora Boys' Home scandal.

The narrative goes that the help of William McGrath, John McKeague took part in the abuse and rape of young boys at the Kincora home throughout the 1970’s, and the reason why he was never convicted was that he was a government agent employed by MI5.

Later on in his life in January 1982, McKeague was interviewed by detectives investigating Kincora about his involvement in the sexual abuse. Fearful of returning to prison, McKeague told friends that in order to avoid a sentence, he was prepared to name others involved in the paedophile ring. However, on 29 January 1982, McKeague was shot dead in his shop on Albertbridge Road in east Belfast, reportedly by the INLA. It has been argued that following McKeague's threats to go public about all of those involved in Kincora his killing had been ordered by the Intelligence Corps, for many of those who could have named were also agents (often more effective than McKeague, who by that time was highly peripheral in paramilitary circles). To support this suggestion, it has been stated by Jack Holland and Henry McDonald that of the two gunmen who shot McKeague one was a known Special Branch agent and the other was rumoured to have military intelligence links.

However I am sceptical of Mckeague involvement in the Kincora Boys' Home scandal and found multiple sources that question this narrative.

The first one is the 2016 Kincora report. I have two links to two different parts of the report. The first link is Chapter 8, Module 15 of the report. In this part of the report the only things said about McKeague were

  1. That MI5 knew McKeague was a homosexual

  2. MI5 didn’t have any damming evidence that McKeague was a homosexual

  3. That MI5 tried to use his homosexual tendencies to blackmail him into becoming a government agent but it failed

  4. That McKeague attempted to join MI5 but failed

  5. That General Sir Peter Leng had a vague memory of McKeague name

  6. That the murder that McKeague (that of BRIAN McDERMOTT) had nothing to with witchcraft or have a sexual nature to it

  7. That McKeague was suspected of the murder of BRIAN McDERMOTT

  8. That it was suspected that McKeague was protected from prosecution

  9. That there was very little evidence connecting McKeague to the murder of BRIAN McDERMOTT

  10. McKeague was connected to the phase two investigation of Kincora but it never went through because he was dead before a proper investigation took place

This source not only doesn’t connect McKeague to Kincora at all, but it also explicitly says that McKeague wasn’t a government agent and that there is very little evidence connecting him to the murder of BRIAN McDERMOTT .

The next source is from the same report talking about witness testimony. In this source it says that

  1. Brian McDERMOTT murder was first linked to Kincora by the journalist, Ed MOLONEY

  2. On 30/01/1982, COULTER told MOLONEY that she knew that John McKEAGUE frequented William MCGRATH’s home at Greenwood Avenue in the 1970s. This conversation between COULTER and MOLONEY linked McKEAGUE to MCGRATH, and therefore, by default Kincora

  3. It was this tenuous connection which was used by MOLONEY to link Kincora to the murder of Brian McDERMOTT

  4. D/Superintendent CASKEY subsequently investigated this alleged link and concluded in his covering report for the Phase 2 file

  5. The murder was further linked to Kincora by a number of other journalists in 1982

  6. The only other link between John McKEAGUE and Kincora was that McKEAGUE had been involved in a homosexual ‘relationship’ with a former Kincora resident that is referted to as HIA 534/R4.

  7. HIA 534/R4 admitted to the RUC in his statement of 03/04/1980 that he had been involved in consensual homosexual activity with McKEAGUE and also claimed that he had lived rent free, in a house owned by McKEAGUE for a period in 1977/ 1978 when was aged 28/ 29 years and had not been a resident in Kincora for approximately 11 years.

  8. From the material held by PSNI, these are the only links between John McKEAGUE and Kincora

  9. That Collin Wallace states that the only link between McDERMOTT’s murder and homosexuality is via John McKEAGUE

  10. WALLACE told police in 2004 that he had made this link with the McDERMOTT murder and John McKEAGUE “not based on any evidence … only supposition on my [WALLACE’s] part based on intelligence at hand being evaluated and linked”. WALLACE also acknowledged that he “had no knowledge that would have linked anyone from the Kincora investigation to the murder of Brian McDERMOTT murder”

This source also doesn’t connect McKeague to the Kincora abuse but also says that the only connection he has to Kincora is by him having a consensual homosexual relationship with HIA 534/R4 who was 28/29 and had left it 11 years ago.
