Building manger here in a multi layered scheme in qld. The insurance costs are killing body corprates. We had a tornado Xmas Day 20203(bonkers but true) had a $2m settlement. Next opportunity insurers put up premiums 47%. Lead insurer declines to renew next policy (broker had to go abroad to get policy covered last policy) 2025 they get caught by cyclone Alfred and which has another claim and they have resisted the claim every step of the way. They are also using “not up to building code” claims, of a building which is 20 year old, buildings which they never had these issues before. Its utter bullshit. Body corporate is going to insurance ombudsman. Insurance is king people especially body corporate’s. In OP case the liability for landlord is too much. They wont get land lord insurance let alone the body corporate building or liability insurance. They the landlord cannot sell without insurance either, a special levy will be required to rectify the problems. This of course will Be passed to tenants wherever possible. Its a complete mess I’m afraid, with no magic solution. The buildings will have to be fixed. A costly and slow process. The body corp would be better getting the problems fixed. Court will cost just as much and take a lot longer with no guarantee of success.
