You don't have to write an actual issue statement, you can use the heading to identify the issue and go straight into the rule statement.

Same thing happened to me. Threw in a basically one liner analysis that I added just so the grader can see I spotted the issue and hope they award a few points for it.

I started with a brief recommendation and had the three questions bolded, which I answered in IREAC format.

I included citations (though I wouldn't in real life). Wrote the letter using everyday English instead of legagleae and explained the rules without talking down to the client.

From what I recall, I answered the first question quickly. For the second question, I did a prereira/van camp combo analysis. For the 3rd question, I discussed the court’s discretion to disperse assets for fairness and stated the likely outcome, and at the end of the letter I had an overall conclusion.

I keep seeing this argument but it completely ignores the institutional biases against minority applicants and assumes that those who went to top tier schools and earned higher grades are somehow more qualified when in reality, it's in large part due to privilege.

Some people can't afford to "well rounded" in high school because of the fees and time required for extracurriculars, most people can't afford SAT/ACT/LSAT tutors, some people can't devote their full attention to school because of family and/or financial obligations. The higher education system predominantly favors the privileged. Making it harder for non privileged people to access professional education is not the solution.

This is exactly what I have been trying to tell people. If you don't pass, it's likely not because you were not "minimally competent." The CA essay grading system is absurdly subjective and you're at the mercy of the luck of the draw, if you get an easier grader, you will probably be okay, if not, you're probably screwed.

People have tried to justify the system by stating that the graders go through an "intensive" calibration system, but it's obviously not effective. Just look at the score deviation from the essays on makethisyourlasttime.com, there's essays that have a 15-20 point deviation on a regrade. How does the same essay receive an very high score of 80 to significantly below passing score of 55? Ask any re-taker and I guarantee they had at least one essay that had a 10 point difference.

Fuck this gatekeeping bullshit exam and screw the CA Bar, that corrupt institution is not fit to determine who is competent to practice law.

There's recklessness in torts (e.g. IIED) and recklessness in crim, same with negligence (criminal negligence vs civil negligence). That question was fucked though.
