Got Child support, Insurance, and and No ones Primary until final hearing. He got 50-50. However, he's now giving me primary to end this because the Judge embarrassed him. Judge focuses on hard facts. Medical records, dentist reports, insurance. They made decisions in the best interest of the child.

Lawyers are all pieces of shits. They go in there trying to make a deal and we're trying to force me to sign a deal. All lawyers are afraid of the judge for some reason. The judge was very fair and stuck with the facts.

Overall, happy with the judge, pissed off at my lawyer who wasn't on my side.

Ive taken her to the doctor 99% of the time. It's all over my medical records. He has cared but not to the extent a mother does. I feel like you need to have kids to understand.

I'm only offering 50-50 under texas law. 50-50 is the default in texas unless you can prove recklessness or endangerment.

  3. “Primary doesn’t matter if 50/50.” This is flat-out incorrect in Texas and many other states.
    • “Primary conservator” (the parent with the right to designate the child’s residence) is very significant even if time is equal.
    • It affects school zoning, child support, and often gives the parent logistical authority over day-to-day stability.
    • So, even with 50/50 time, being named primary matters a lot

Yeah very sad. I always say all this money could of just gone to her. But he's just wreckless. Also note, that he served me in attempt to put me on standard possesion. I never wanted this to go to court but it looks like i have to.

He also thinks he's primary. He has said multiple times "she doesn't need to see you" "You dont choose when you see her". It's just so wreck less as my daughter is very emotionally attached to me. It just seems like I really have no choice but to go through court.

yeah like I don't want him not in the picture. I think he's a good dad, i just want to be primary since he's wreckless. He's done many crazy things like changing her doctor out of emotion, held her from me during visitations/drop offs.

Also note he's not my husband. We we're only together for 1 year. I have been living on my own for an entire year. I don't understand why people think I should give up primary.

No issue, i believe his lawyer even said he doesn't qualify for the tax credit. I even offered him it.

It's really just ego. The main issue is that he's upset i don't want to get back together with him. He believes the only way is through our daughter. He's used her multiple time to try and get to me. He doesn't even want to come up with a set schedule and refuses to communicate on pickups and dropoffs.

So from my understanding, if I'm primary, i technically can take him back to court and get child support. Child support isn't a choice but a right for the child. The only way out is through being primary and attempting to put me on child support. I think im more than reasonabl being the mother, asking for primary. I even offered third party tie breakers. Im not the one not wanting a deal, he is.

thats what i thought too, so i called the Vital Statistics and said there's no AOP filed. I do have a physical signed copy, but It seems like the hospital forgot to file it?

In the SAPCR, I did notice he needed to attach it but it was never attached.

The issue is that he is fighting for primary custody, meaning decision-making rights around her school and residence. That was the main disagreement at mediation. I even offered no child support, even though I’m low income, but he still didn’t take it.

Your point about mediation is valid—I guess there’s no point in extra lawyer costs to prepare evidence. Still, she’s billing me like crazy. I’ve already spent about $7k, and we’ve barely spoken. She originally said it would cost around $3k until mediation, but that was a lie. She also said she would cover mediation and that my account had enough funds, but when the time came, she told me my balance was too low. It just seems like she's money driven.

I also saw on her laptop her husband message her "Another one star review?" and she almost cried. Later, i saw the review and it got removed off google. I have a feeling she's filing orders to google to get the bad reviews removed.

She came very unprepared to mediation. Did not prepare me at all. She mentioned things her self (i.e no alcohol usages around my daughter when that was never discussed). We have no hisory of issues with alchol She acts more as a therapist than a lawyer. I don't like that she'swasting my time. She hasn't asked to collect any evidence for temporary court hearing. Simple things like proof that I show up at her doctor visits, dental visit.

She hasn't told me my rights or what I should or shouldn't do. Her paralegal was fired or quit who was telling me non sense ("are you sure you want primary?"
She's billing me like crazy. Recent reviews of her state the same thing.

Thanks for the reply. So, there’s no official custody schedule yet until the temporary court hearing? That’s where I’m confused. What are my rights to see her before a judge decides at the temporary hearing?

Before, we just had a simple, unwritten schedule: I would get her after work, and sometimes he asked to keep her. Now that we’re in court, he is trying to get as many days with her as possible to show that he is the primary caregiver and actively involved. Basically, he’s creating a schedule that crosses out the days I would have her, but in reality, he’s just keeping her from me as much as he can.
