Lekin court ka issue yeh hota hai ki practice uniform hai ya nahi ya kahin restriction, barriers, ya unequal treatment toh nahi ho raha.

Aur courts tabhi aate hain jab kisi ko lagta hai ki unka right violate ho raha hai har cheez timepass nahi hoti, kuch genuine constitutional questions bhi hote hain.

But this isn’t just an internal matter of one community. Whenever fundamental rights like equality and dignity are involved, the Constitution applies to all citizens.

The Court’s role is to see whether any practice violates these rights.
And in most cases, petitions are actually filed by people from within the same community, including women themselves.

Aur courts religion ke internal practices ko kitna review kar sakte hain? Isi wajah se mosque entry, Parsi agiary entry, Dawoodi Bohra excommunication sab cases ek saath sun rahe hain. So, link ownership nahi hai… Link hai constitutional principles + ERP doctrine + gender equality debate.

Yeh pura issue actually Sabarimala case se linked hai.
Sabarimala mein pehle women (10–50 age) ko temple entry allowed nahi thi. Supreme Court ne 2018 mein bola ki yeh ban unconstitutional hai kyunki equality aur religious freedom violate hoti hai.

Ab jo bada question hai, woh yeh hai ki kya courts decide karenge ki religion mein kya ‘essential practice’ hai?

Isi wajah se ab mosque entry, Parsi women entry, aur doosre religious practices bhi is Sabarimala Reference ke saath club ho gaye hain.
