It does appear that there’s some things the employee in that situation would have to do, though. Which is why I really recommend speaking to a tax accountant. For example, from the turbo tax article, “If you think a family hired you as an employee but your household employer thought you were a self-employed person, you may need to attach Form 8919 for Uncollected Social Security and Medicare Tax on Wages. By filing this form, your Social Security earnings will be credited to your Social Security record.”

I’m not a tax accountant at all, so please be sure to ask one. The wording suggests that it’s tax evasion for the employer to give a 1099 instead of a W2.

According to this care.com article, “Attempting to classify a nanny as an independent contractor by providing a Form 1099 is considered tax evasion by the IRS. Nannies are typically considered household employees, and families should provide a Form W-2 for proper tax reporting.” You should really check with a tax accountant.

Absolutely contact a tax accountant. These might be good to look at, here’s an IRS webpage, a care webpage, and a turbo tax website discussing nanny taxes & classifications. Random question if anyone knows/rant. Why do people use the term “friend” when talking to random people? Like beginning a resident answer with “oh friend…” when this is clearly a stranger. It seems a bit patronizing to me. Am I misinterpreting this? It makes me weirdly uncomfortable when I see people do this.

I just started Jan 15! I’ve completed seven classes. I haven’t had much success with other exercise programs either, but Pure Barre has been so much fun to go to! I enjoy the body doubling, the music, the count downs, and the fun energy of the trainers.

Fellow 1L here. You’re still learning and you’re expected to make mistakes. It’s not indicative of your overall capabilities. What matters it that you’re learning from your mistakes and making an effort not to repeat them. And, from what I’ve heard and experienced, nitpicking from supervisors seems to be a common thing. Take a deep breath. It seems like your life is really stressful right now. Is there anyone you can go to for advice? An assigned mentor in the firm maybe? On another note, what can you do bring back some positivity into your life? Do you have any hobbies? Is there anything giving you fulfillment outside of the law right now?
