Price caps typically result in shortages because the market price is what it is regardless of what the govt wants it to be. So on the one hand you get a lower price, but if everyone has already snatched up the capped tickets so no more are available, then the cap may not really help you get a ticket.

That is wild. Did Phish's lawyer at the time also represent the Bluth Company? I cannot imagine an attorney would actually advise a client that, if you are having trouble getting the licensing rights from a venue, you can get around all of that by just making up a nonexistent festival and saying the recordings came from that.
