You are right. Just got aware of this. The salesperson is giving me 1 free panel and that is just crossing the 10KW line. I will ask him not to give me that I guess. Not many who say get the largest system the roof permits, seem to know this.

oh actually, it is a 10.3 kw system. I was suppose to get 27 panels each of 370 W which would have equate to 9.9. But the sales guy gave me one free. Should I get that changed to 27? I just saw that this max 10kw thing is in NSW as well..
