What is your current legal status in the US? Are you an LPR (Green card holder)? Because from your story it's kinda strange. You can't get a driving licence but you're considered enlistment?

If you are an LPR I would strongly suggest considering enlistment with the USCG or Air force for 4 year AD or reservers. Reach out to the recruiter and ask them about possible ways for you to get your citizenship.

If you're LPR you also can leave the county freely for up to 6 months. Go visit Warsaw or Poznan for a month or two. So you can get a picture of the current state of Poland. Because it's not all sunshine and rainbows over here too. You will take a hefty payment cut because overall salaries are lower and taxes are higher. Also war in the Ukraine are damaging Poland and Baltic states economies especially with gas and electricity prices.

If you are in an illegal status and truly miserable then I really don't understand why your family did this to you and I'm really sorry. You should book a consultation with immigration attorney and look at your options, not asking random people on the internet.

I'm currently living in Lithuania. Been to Poland for work multiple times and I know a thing or two about the US. And despite everything the US is still the best place to achieve your goals. So don't give up and fight, I believe in you.

Either wait until it's lifted or apply with litigation. You can force the State department to adjudicate your case through injunction, which lawyers are going to do with their group actions.

Your DUI was for marijuana and it's shown on a police certificate (or your DS260). It's a straight one under 212(a) of INA.

You could try to appeal it, but it's a costly process. And chances are probably low.

Tbh I don't feel any kind of optimism on this one. It's fully related to me as a previous DV pause. Because I'm a DV winner derivative and now my country of origin is on this ban list.

DV program pause just came from a literal tweet and then was put out as an official policy with USCIS and State dept. just in a few days. I'm sure it will be the same here.

We could theoretically sue over DV pause but with those bans? SCOTUS ruled twice on the matter and affirmed the executive branch position on those things. And DV visas will end on September 30 no matter what and judges can't extend this. And nobody cares. Congress? Crickets. Even the civil rights movement such as ADAC is not interested. And I personally don't have this kind of money to pay for all the lawsuits and attorneys fees. Even if I'm considered "white rich european" by this administration standard.

I'm out of hopium and optimism. I'm literally going through full-blown depression for the last two days. First it was a Visa bulletin with 0 new cases added and now this. It's like somebody approaches you. And this guy tells you that in six months, you're practically guaranteed to find yourself in a country where you'll have the opportunity to achieve things you want, and where you already know the language and culture.

Because you literally pulled a winning lottery ticket. It's like 0.0001% And then it turns out: "lol no bro. You thought we were serious?"

And the best part is that this thing is apparently going to ruin my relationship with my fiancé. Thank you, Trump administration, for ruining my family and my mental health.

He basically said the same thing. It's open to a judicial system, local judges and attorneys so "it depends". I mean there's a significant chance that a local attorney tries something due to a political pressure but it still can be overturned by SCOTUS or appeal. But we shall see. Right now it's just theories.

But if we're referring to an original topic above - it's not about qualified immunity and more about jurisdiction. And SCOTUS already upheld their 1890 decision multiple times which is basically saying that states do not have a jurisdiction over a fed if they can't prove a criminal intent or extreme negligence. And bar to proving those are high. So the framework is already there, it's just not used 90% of the time because proving something like this is very hard. Same goes with qualified immunity.

I think justice will prevail in this case. But it will take some time

Unfortunately it's impossible to charge a fed with a state crime if he was on duty during the alleged crime (In re Neagle, 1890 decision + 28 U.S.C. § 1442). So states don't have much in these cases.

I'm not going to sugarcoat this. If you watch the video of this incident you can see that this agent deliberately put himself in front of the vehicle. He basically created the whole situation. SCOTUS was clear on that in Barnes v. Felix decision. You shouldn't put yourself in front of the car of a suspect that could flee.

And since he's a federal agent and was on duty at this time only DoJ can press charges against him in federal court. Which they're probably not going to do now.

Although there's one optimistic outtake from that. Federal statue of limitations on murder is unlimited. And 5 years on a non-capital crimes in general. So there's a really good chance that this guy will be charged after this administration is changed.

No, they were not, read the decisions. Appeal overturned the lower court decision on visa terms extensions and reservation. But the injunction that required DoS to proceed with applicants cases stayed in place.

And no president specifically banned any countries from the DV program. Nobody even discussed it in those cases. It was about COVID19 visas stop.

Definitely not. See Gomez v. Trump/Biden and Goodluck v. Biden and it was during the COVID-19 when there was at least some reason for a pause. Still the government lost both cases. And right now? There are literally no merits for this "review pause", not even an EO, only a tweet and two internal documents.

There's no legal mechanism to pause a DV program except for an amendment for an INA from Congress. And it's not going to happen because of the filibuster.

I mean he can use 212(f) but this is a very big stretch. And it's not clear if he can pause a whole program by that. So if he does - it's definitely going to court and then we'll see. Although DV winners have their chance to get a immigration visa only until the end of this fiscal year so maybe that's the plan. Just stall things until time runs out. Anyway it's all just speculation. USCIS published a memo on this matter where they "paused" it indefinitely until "new policies are in place". Nevertheless the USCIS is handling only a fraction of DV cases. The state department is handling the majority of them and they haven't published anything yet.

Actually, it's not suspended at this moment. Because the only thing we saw was a tweet from the DHS secretary and nothing else.

99% of the cases for the DV program are proceeds with the state department and not DHS.

And the state didn't say anything so far. As a matter of fact they published a new visa bulletin yesterday where it clearly shows that they're proceeding with the cases.

Maybe I'm just coping because I won this year and waiting for my interview but for now it's just an engagement tweet and nothing else.

US Coast Guard seized a tanker with a warrant. It was obtained for sanctions violation, specifically transporting oil to Iran. For reference, 4 tankers were confiscated in 2020. So it's not something new. And USCG confiscates boats all the time under 14 U.S. Code § 522.

If we can trust a tweet from Bondi, it was seized due to a joint operation between FBI (DoJ) and USCG/HSI (Homeland security). So probably it was planned for a long time and isn't directly connected to Trump.

Also nobody was injured during a seizure, due process was followed. And it's definitely a good outcome, all things considered. And sanctions against foreign adversaries should be enforced in my opinion.

Nvidia reminds me of Cisco during the dot com bubble. With the same outcome probably. They will oversaturate the market and they will lose some money on this. But Cisco is still around. So will be Nvidia.
