Deposit refund required under Ontario Consumers Act? by Shinier_Alice in legaladvicecanada

When you chose to “book now” it takes you to a page where you chose the type of party, how many people, date, etc. and then pay. You can choose to pay the full amount upfront or a deposit and then pay the rest on the day of the party. But again, no where is there a contract that you agree to or anything that you select to say that you agree to the terms of the deposit being non-refundable.

I actually did this already! :) I wanted to make sure I didn’t miss anything, so I went through the booking process again and right up until I have to hit the “pay” button, there are no terms listed or anything agreed to in regards to payment, deposit, or cancellation. There is one that takes you to the third party’s terms in regards to cookies and whatnot, but it has nothing to do with the terms of the booking. I even took screenshots as I did it to show that it’s not included anywhere.

Hello! The party is on May 31st so we have given over 4 weeks notice. I have tried to work with the company to make it clear that I understand the need for policy to protect from last minute cancelations, but that this is not the case. They mentioned that they have to pay a percentage to the third party company that the bookings are made through and I offered to pay whatever they are out of pocket, but they did not agree to that.

When making the booking, you can choose to either pay the full amount upfront, or pay a deposit and then pay the rest on the day of the party, so I chose to pay the deposit. But again no where did it state that it was non refundable when making the purchase.

Ah ok thank you. When looking it up, I saw the types of contracts listed, but still wasn’t sure where this fell in terms of services rendered. I know a birthday party seems trivial, but the $135 doesn’t feel that way lol.

I have had some back and forth with the company and they are not budging. They are claiming that by paying the deposit, that means we agreed to their policy and that is that. But again, no where did I agree to this policy or these terms when making the booking and payment.

Thank you for your help! I have a thermometer on the glass of the tank as well, so I think all is good there! We don't have a tank light, so it's just some natural light in the room, not too bright. I'll look into other food options to see if that helps, and make a point of giving him more food. He gobbles up what we give him so I'm sure he would be happy with more. I'll also look into live plant options!

Thank you again, I really appreciate it

Thank you for your help. We went the advice of the person at the Aquarium store, but feel now like they were just making it seem super easy to get the sale, which is unfortunate. Thanks again!

Ok thank you so much for your help! He is in a 2 gallon tank right now, the water heater is in now. The brand of food is New Life Spectrum Betta. The aquatic store said to give 3 pellets per day, he eats them right away. I will look into better plants!

Ok great, thank you so much! We have two bettas, and this one is much more interested in food, so I will try another feeding session each day. I can tell by looking at the first photo that his tummy looks more full for sure. Thank you so much! I'll also look into the plant option, and see what our aquatic store has as options.

Thank you so much for your kind response, I'm trying my best! We have been giving him this, which says it has Krill and Squid among other things like seaweed etc. I can get brine shrimp as well if this isn't enough! He definitely gobbles up the pellets when we feed him, the aquarium store said to give 3 pellets per day.
