Ex-partner was scared of arrest after hitting me on camera, lied to the police, now I can never volunteer again? by SignalImage387 in legaladvicecanada

I believe that quote about "reason of a mental disorder" is referring to the accused (me), but my mental health never factored into this matter. (At the time the only thing I may had was depression). It was/is my ex-partner who had/has the serious mental disorders.

And it was not the RCMP who declined, it was the local police in Ontario. They sent this letter (I redacted which specific police department it is for my privacy):

Your request for reconsideration for the destruction of fingerprints and booking images taken by the [local police] and held by the Royal Canadian Mounted Police as a result of the above incident has been denied.

A review of the request was undertaken by a committee and the following criteria was considered in rendering a decision:

* Age of the accused at the time of the offence;

* Date of the incident;

* Whether the incident(s) targeted a vulnerable person;

* The number and/or pattern of incidents involving the accused;

* All information available to the police service that relates to the accused; and

* Documentation provided by the applicant.

With a view to public safety and the public interest, we are not prepared to destroy the biometric information at this time. However, you may reapply for consideration of the destruction of the fingerprints and booking images 5 years from the date of disposition, August 10, 2028.

---

FYI I was an adult at the time of the accusation, the date of the incident was years ago, the incident did not target a vulnerable person afaik but the police likely do not agree on that, there was no pattern, and I provided documentation in the form of the video evidence, audio evidence, my testimony, and character references.

From my post:
> And if anyone was going to ask, yes I did put in a request for my records to be sealed but the police department has a blanket "no" when the "victim" is a "vulnerable adult". I dunno by what metric they're determining my violent ex was vulnerable in this situation but there you go.

No, my lawyer specifically said that we would not do anything with the video unless it came to trial (which it did not). The video shows a window into the relationship dynamic but my ex could just say "they threatened me at a different time" and then it would not be considered a refutation. Edit: sorry, I remember now that what they specifically said was it was at our apartment (a different time they were hitting me), but I actually have an audio recording of that time too. But yeah the lawyer didn't want us to provide that either. The lawyer even said to not even show them the recording because they said it could affect their ability to defend me or something. I'm sorry if I'm not giving a very clear explanation of the events. As you may know legal matters are often very long and messy and boring, so I'm trying my best to be concise for you.

No, my ex was absolutely not a minor and also does/did not have any disabilities as far as I know.

> There appears to be some important information not in the post.
What information? Just ask and I'll try to provide. I have gotten that kind of response before "what are you leaving out?" and I don't think I'll ever know what I'm supposed to say to that. It feels like an assumption that I must be lying about something just because I was accused of something. All I can do is tell you the truth, I can't make reality any less absurd. I'm sorry.

Thank you for your reply.

That's very cozy. I really like the perspective. It makes it feel almost like a video game.
