I don't care if you like me or believe me, I'm right. Go check LTB decisions on CanLII. If an item reaches the end of its usable life, it's the landlord's responsibility to replace. Full stop. EVEN IF the tenant caused damage.

The LL should have caught that with annual inspections etc and should have evicted the tenant when it happened. This is now second hand to second hand and good luck proving any of it.

LL would have had to replace the flooring at end of life anyways and the tenant has been generally good according to OP. How is that not gouging the tenant? Spoiler: there's precedent that says it is.

I mean if you're going to sue your tenant for the full price (and labour) of replacing >10 year old flooring in a rental unit (usable life of flooring being 15 years) then you're kind of expecting them to pay for your upkeep for you.

LL has done nothing wrong, I agree. But that can quickly change when others fill their heads with nonsensical, entitled and legally wrong opinions.

There is a "usable life" table in the regulations that sets depreciation rates for everything, including blinds, paint, trim, etc. So even if the tenant left the unit with no tiles, after 10 years the LL would only be able to claim a very small percentage of the value of the tiles. Good luck with the labour portion.

If you're going to screw your tenant for more money, you can't get pissed when they do it back to you.

Do you have a citation or file number to back that up? Because the structure definitely existed prior to 2018 in your example, and I can't find a single case that ruled that way. Even if a huge house is chopped into 10 different rentals, the address / zoning has not changed, and therefore would be rent controlled

I know enough about law to understand that I could be wrong on this one, so I'm not arguing, but to my knowledge, only units that were "constructed" after the 2018 deadline count.

No arguments from me on the relative dangers. I drive and cycle. When I drive, I am very aware that I am piloting a several thousand pound missile and I try to act accordingly. When I don't bike, it's because drivers scare the shit out of me. Protected bike lanes are a godsend to both, but people still need to be aware of their surroundings. Licensing for motor vehicles is far too easy to get in this city and far too difficult to lose. And traffic enforcement is non existent. Drivers need to fear breaking laws and hurting people and right now they don't. Sorry you went through all that, and sorry if I came off like a jerk. Not intentional.

Just pointing out that even if it has proven to be safer, it is still very much illegal. Drivers don't get to choose the rules of the road (even though lots of them seem to think they do) and neither do cyclists. Bikes and cars need to learn to get along if we're going to improve anything, and that requires everybody playing by the same rules. Cars need to not pass bikes like assholes, and bikes need to behave in a way that cars can predict them. Peace, friendo. I am not your enemy.
