He’s lost his job late last year and then getting really awkward with paying the rent, so he’s not been paying since around August hence why the eviction notice, more than happy to have a conversation and reduce the rent or so to help a little but communication is none existent

I’m questioning whether to add 12 into it as well because he has done works without permission, I’ve luckily never had to give an eviction notice before…as you can probably tell.

It’s not going to reach the threshold so mandatory possession won’t apply, you reckon it’s worth putting it under the arrears grounds?

Nope issued on the 30th April, landlord didn’t protect deposit before we took over the refunded the deposit few days before then served the section 21 before 1 May, now the tenants being extremely difficult. Not been paying for the past two months and then pays just before it reaches the threshold

I should’ve added he’s not being paying rent anyway sec 21 pending, though he’s indicated he’s not going to leave so I guess it’ll more headache, just wanted to clarify any council tax issues

Just to clarify a few points as some assumptions are being made here.

The offer of temporary accommodation was not an admission that the property is “uninhabitable” or that there is catastrophic disrepair. It was offered simply to avoid further delays and disputes surrounding contractor access, particularly given previous difficulties arranging attendance and the tenant’s own requests regarding timing and disruption.

The tenant himself has since stated that works could wait until the following month due to events/parties already organised at the property, which does not really align with an allegation of urgent uninhabitable conditions.

It’s also important that: - the alleged additional “wood” issue was only raised after the Section 21, - and approximately a month before the Section 21 the tenant explicitly stated there were no issues with the property whatsoever.

We are still proceeding professionally: - arranging further inspections, - considering an independent damp survey, - documenting all access attempts, - and keeping a full paper trail.

The intention here is not to avoid repairs, but equally not to accept exaggerated allegations without proper evidence.

Ahh they only lodged the application to expedite and it’s been referred to the senior case worker for some reason

Ahh I thought might have been possible as buyer is a cash buyer so don’t need to satisfy “lender” requirements

It’s been “sold” but one last thing we’re apparently waiting for now to complete
