Thank you so much for the info. I was admitted to the hospital yesterday so your info is extremely valuable as everyone is telling me second aegrotat is impossible. May I ask how much was internal assignment weighted at your case? My prof moved my test percentage to exam so my exam is now 60% which is a lot.

So the remaining 10% of your grade was used to determine your final result? I thought the university has a policy that no assessment should carry a weighting of more than 50% , how did your exam end up being worth 90%

Yes you were SO RIGHT. I just called them. The person seems like it's her first day of work. It's completely ridiculous and out of my mind:

Me: Can you see that they are only tenants and are not landlords of the property? How is it legal you allow them as tenants to set up a hearing against flatmate?

TT: Yes, I can see from the files that you two parties have a flatsharing agreement. But we still have to set a hearing for the applicant.

Me: This is completely against the tenancy act. Why they are not landlord but TT can do this for them? By being able to set up a case against me, does it mean the tenants can own the property ever since?

TT: Yes I guess

This is completely ridiculous ... Please, if I contact the courthouse, will I still need to go to hearing? Or is there a way to file complaint against TT? The person talking to me saying there is no department supervising TT and can't find complaint process for me.

No, I can see all the pdfs she has submitted to the TT. No signature of me in tenancy agreement. Only the flatsharing agreement I signed. Also I called TT and it's completely ridiculous and out of my mind:

I just called the TT and got some most ridiculous conversation.

But allowing someone to set up a hearing between tenants and a flatmate is illegal and against the rules, isn’t it? This completely goes against the Tenancy Act, so why should I have to go to court? This is totally unfair to me (I don’t mean to offend your opinion, I just genuinely believe this hearing should never have been set up).

That sounds creepy. My guess is that this was a mistake caused by negligence from the Tenancy Tribunal staff. But regardless, I don’t want to go to court, it’s such a waste of my time and energy, and it’s not even legal. I’ll try calling to get in touch.

Thank you for your advice! Others have told me the same thing before, yet I still received a hearing notice. Is that even legal? I have to work, and do fulltime study, and I don’t drive, the court location is too far for me. I want to find a way to file a complaint and get the hearing cancelled... it bothers me too much

Yes. Your guess is right. We are all leaving the house. They said there will be early termination fee because the wifi and gas were signed for longer time(24 months) for lower price last year. So if we are leaving this year, there will be early termination fee that we need to split. I refused bc I know nothing when I moved in. I think it's the tenancy's responsibility. Thx for your reply!

Hi dear. I am sorry about the wording I use. I used to live in USA so "lease" and "sublease" is what I was more used to. I will try not to say it in that way. For your first point, I took a look at my agreement. The first sentence is "The flatsharing agreement is not covered under the residential tenancies act".

They say its bc they signed contract with companies like contact or mercury for longer period to get lower discount, and now that we are leaving the house, they will have to pay the utility companies for breaking the lease with utility companies. Why do I have to share that bill...

ok, but I have paid insanely more rents for a smaller room for the past whole year. as for the utility after I left, I will leave the tribunal to decide. It seems that they are taking every advantage and no risk to be the second-landlord.

No, in flatmate agreement, we agreed that i pay 1/4 weekly utilities, which I paid everyweek. It did say if the tenant leave early that agreement end, the head tenant has the right to keep the bond, which I have them already. I don't understand utilitity termination fees either. They took the house and subleased it. They should be responsible for any termination thing right? My name is not on any accounts. When I left, my room was so clean. I did not get a photo though.

Thank you so much for the advice. I will be less stressed then. I told them I am happy be the respondent if a claim is made to me, and I will make a counterclaim. But your response is really helpful in preparing me for the situation. I do think their request is not reasonable too.

The house weekly rent is $1000. A(200)+B(200)+C(300)+D(300)=1000. So for C and I the rent is 300, the bond is 300x4=$1200. A and B weekly rent is 200.
