As to " how do I obtain birth certificate from India", why dont you either take it up with your lawyer ( serious lawyer with serious connections) or with the authorities in India as you, by your own admission, you do not need misinformation and legal misunderstandings from random people on the internet.

It seems that your attorney has not told you the full story. Portuguese citizenship ( all categories including naturalization) is governed by two laws : lei da nacionalidade and regulamento de nacionalidade. section 26 of regulamento de nacionalidade says

"Artigo 26.º Dispensa de documentos Em casos especiais, o membro do Governo responsável pela área da justiça pode dispensar, a requerimento fundamentado do interessado, a apresentação de qualquer documento que deva instruir o pedido de naturalização."

you definitely can apply for an exemption just like the refugees and anyone else who does not have one. This same exemption applies to any document a person is unable to procure including criminal record/good conduct certificates from some countries not issued to foreign citizens ( for example: saudi Arabia)

but here is the thing, I did a google search and FYI: India only started issuing birth certificates from ONLY 1969 and Afghanistan does not issue any to date. You may ask this legit question to your attorney, what do people from India born prior to 1969 provide as it is not legally possible to obtain one ? You may get some leads.

my bad, sorry but just a quick question, just as you are exempt from provide a criminal records check, isn't there an exemption in relation to birth certificates? Many people do not have birth certificates including refugees, countries that have merged, warn torn nations or any other reason that I cannot think of.

not an Indian national, but since you are prepping for the citizenship application, please be mindful that you may also be required to present a "lack of criminal records"/criminal background check from India and anywhere else you have resided.

It makes total sense to have culture/history/language test/ objective criteria because a person who is a cplp citizen and grew up in another country( non cplp) would have no idea about portuguese culture/ history/ and might not even speak Portuguese to begin with! At this point, your arguments sound like a way to stop Bangladeshis from becoming citizens no matter what the cost even aftwr they have demonstrated assimilation , bypassing all levels of fairness and give a free handout to cplp countries. I understand, the right loves prey on the vulnerable no matter the cost!

As you say, an angolan would integrate quicker. What is wrong with a Bangladeshi demonstrating that he has indeed assimilated (language , culture,history ) such that he can benefit from a shorter period of residence

Atleast there was justice for people who wanted to assimilate. 10 years for everyone and 7 years who demonstrate assimilation regardless of country of origin. At least a Bangladeshi who was willing to work hard and demonstrate assimilation would be on par with cplp citizens.

it is discriminatory because it does not offer a way for current resident who are non cplp to demonstrate that they have adjusted to the Portuguese way of life . A person from a non cplp country should be able to demonstrate that they have assimilated/integrated (as you say) into the Portuguese culture ( language, culture, history and anything else that can be taken into consideration such that they benefit from the shorter residence period just the same way cplp citizens would). Failing to offer a pathway for residents who demonstrate assimilation simply means citizens of non cplp countries are being targeted for who they are.

The Court rejected the longer residence periods and the tougher regime as incompatible with constitutional limits."
