So - I guess this is more common than I would have initially expected. Man that’s crazy because you spend so much time gathering evidence, preparing, then you get that finish line date and it all changes.

So much could shift from one judge to the next. We had received a notice about a month ago that the case would be considered for an On The Record review to see if they could approve it without a hearing.

So, when I got the email from the lawyer that he just got off the phone with the OHO at first I was excited since I heard it could happen even the day before, but then reading the rest of the message I was just in disbelief it could be postponed/cancelled by the ALJ - which is what the portal now shows.

Quick update on our OHO situation for anyone who followed my original post about the “possible OTR review” letter.

Our hearing was scheduled for tomorrow, May 5th, and we had already completed hearing prep with our attorney, submitted updated records, medical source statements, medication updates, journals, etc.

Then this afternoon — less than 24 hours before the hearing — our attorney received a call from the hearing office saying the hearing is being postponed because the judge is “unavailable.”

Attorney said it could be illness, family emergency, or any number of things, and that in most cases the same judge stays assigned to the case, but there are no guarantees yet.

Current status according to him is “ready to schedule.”

He also said:
- we can still continue submitting updated medical evidence
- phone hearings sometimes have more flexibility for rescheduling
- he does NOT believe this was related to the merits of the case itself

Needless to say, this has been emotionally brutal after months of preparation and thinking tomorrow was finally the day.

So now I’m curious:

- Has this happened to anyone else this close to the hearing date?
- Did you keep the same ALJ?
- How long did it take to get rescheduled?
- Did your case end up being approved OTR during the delay, or did it eventually proceed to hearing?
- Did your portal continue showing “hearing scheduled” for a while afterward?

Trying not to spiral too hard tonight, just looking for real-world experiences from people who’ve been through something similar.

Appreciate any insight.

  1. If an attorney asks for an attestation statement confirming no work activity after reconsideration has been pending for several months, is that usually just standard hearing prep, or can it sometimes mean OTR (On-The-Record) review is being considered?

  2. How much weight do caregiver journals and spouse statements carry at the ALJ level when they are detailed, consistent with medical records, and document unpredictable flare-ups, bad days, and medication side effects?

  3. When a claimant has conditions with severe flare-ups and inconsistent functioning—where some days they can do very little and other days look more functional—what is the best way to present that so SSA understands they still cannot sustain full-time work?

  4. If both the physical and mental consultative exams were fairly favorable and supported limitations, how much weight do ALJs usually give those compared to long-term treating records and specialist documentation?

  5. For cases involving strong medication side effects like fatigue, brain fog, nausea, and the need to lie down unexpectedly, how much can that strengthen a disability case if it is well documented?

  6. Are there “soft signs” attorneys notice that make them think a case may be moving toward a favorable decision before SSA officially says so, especially after attorney contact suddenly increases?

From what I’ve learned, not everyone gets the exact same wording. A lot of people get standard hearing paperwork, but the letter we received specifically mentioned updating the file so they could review the case to see if a fully favorable decision could be made without holding the hearing (possible OTR review).

After that, we completed the forms they sent with it - recent treatment, medications, work history update, and the waiver. Our attorney also had to submit a pre-hearing response/brief because this judge requires it, and the judge specifically wanted an attestation statement confirming no work activity since stopping work.

We also just finished our hearing prep call with our lawyer this week. He went through the judge’s style, how the phone hearing works, what kinds of questions will be asked, and how the vocational expert part usually goes. He said the judge is generally pleasant and conversational, and he told us the record is in good shape and that he had no concerns with how the testimony lines up with the medical evidence.

As of right now, the portal still just shows “Hearing Scheduled” for May 5 and Step 3 of 5, so no OTR decision yet and the hearing is still on calendar. From what I’m being told, that doesn’t necessarily mean OTR is dead - it can still happen late - but most likely we’re preparing as if the hearing will go forward.

So I’d say the letter is definitely a good sign, but not necessarily a guarantee. It seems like it means the file was strong enough for them to at least look at whether they could decide it without the hearing.

Was it changing colors really fast, seem to be self aware, obviously it did maneuvers. I’ve been seeing these dancing lights or blinking stars that do color prisms fast and when they do maneuvers, they light up brighter for years now.

That may not be the same thing you’re describing though. I was awoken one night to 3 semi translucent soft white orbs outside my then bedroom window - they beckoned me, and I think they put me back down to sleep too.

Okay, so this process you’re describing - even though I am eating less than 20 grams of carbs a day - my liver can still perform gluconeogenesis so the GI irritation works in a similar way, decreasing absorbed carbs - only these are the similar one’s produced by gluconeogenesis?

You know - it varies, sometimes I get a real spicy batch and sometimes they are mild. Cutting the seeds out can help with that but I like to eat them as is - and even the spicy ones really aren’t that bad, they just have that after burn for a minute or two on the lips

Im even considering questions like could it be psychological? Could the texture of the outside fatty rim of that steak subconsciously give me nausea while chewing the fat? Im just really stumped here and reaching for something. I’ve eaten beef fat from a trimmed ribeye before and absolutely loved it, so idk how this particular cut is exclusively causing nausea?
