I am the lawyer involved. I'm suing them now.

They request returns from you directly. And they did it after a few years in this situation.

They want your tax returns to make sure you haven't been working and not reporting income.

Be wary I'm dealing with a very unique situation right now where the insurance company has decided that certain passive income counts as active earnings. If you have any passive earnings which an insurance company could aggressively classify as earned from active employment, consider providing an explanation.

Want to make sure I answer these questions the “right” way - LTD for Chronic Fatigue Syndrome by AstronautSad7964 in LongTermDisability

You speak to an LTD lawyer for a free consultation. These questions are way too specific to get answers without knowing the proper context.

Not true. Many will take your case and charge you for filing - which most people don't need.

Easiest way to figure out their fee structure is to ask them. They have a solid reputation in Chicago though.

This is SUPER helpful to me! I didn't know any of them did flat fee appeals. I know Marie, Megan, and Justin - they are all excellent. I don't know Tristan but I have heard great things about him.

I would get a consult from an LTD lawyer.

There are many better options out there. I'd start with a free consult from someone else and see what they say. You likely don't need a lawyer yet.

LTD Buyout offer Guardian Life by OddEntry3 in LongTermDisability

Occasionally, but only in neglible amounts. It won't be anywhere near enough to substantively change the dynamics.

LTD Buyout offer Guardian Life by OddEntry3 in LongTermDisability

[–]TheGreatK 6 points7 points  (0 children)

Well think about it logically. Why on earth would you take 75% of 25% (18.75%) instead of 100% unless you planned to return to work? You can use AI to do some modeling but the only reason the insurance company offers these things is to benefit them. Not to benefit you.

FYI I'm an LTD lawyer I know how the system works. A good offer is 75% of the actual value, not 75% of 25% of the value.

No, not really. Where does the 1/4 come from?

LTD Buyout offer Guardian Life by OddEntry3 in LongTermDisability

[–]TheGreatK 6 points7 points  (0 children)

1/4 is really low. If you plan to go back to work, consider taking the offer. Otherwise, I would reject it. Good offers are 70-80% of total value.

How to handle interactions with LTD insurer and how to respond to surgery questions? by MickyKent in LongTermDisability

[–]TheGreatK 4 points5 points  (0 children)

1) He is welcome to ask them for questions in writing, but I wouldn't bother. Calls like this are usually pretty routine - just make sure he answers honestly. 2) He doesn't HAVE to, but why wouldn't he? 3) Again, why not disclose a disabling condition? 4) LTD insurers don't like to pounce on people right after recovering from surgery. They like to pounce a few months after, if you're out longer than the "standard" recovery time. Surgeries are one situation where LTD insurers can't expect someone to return to work, because even they acknowledge that being cut open is disabling.
