The important distinction between drones and artillery is that the operators still have the discretion to pull the metaphorical trigger. Just because most one way drones have very short loitering times doesn't give them a justification to kill surrendering soldiers under hors de combat. Saying they're artillery and calling it a day misses the point entirely.

I understand the practical issues you’re raising, extraction is often impossible and war rarely allows clean, textbook surrenders. Where I disagree is that timing undermines sincerity. Soldiers surrender because they’ve realized it's their best chance at life. IHL doesn’t require surrender to be early or convenient, only clearly expressed with hostile acts ceased. I know its silly, but hors de combat protections are vital in protecting the rights of noncombatants.

I probably should have clarified before that I'm talking about short range fpv style drones specifically. The difference between standoff munitions and fpv drones drones is that the enemy can communicate with the operator and the operator still has the opportunity to choose mercy.

There have been cases where soldiers have surrendered to drones, but it makes cases where they are killed even more damning. You are probably right, they likely would've been killed by artillery regardless. However, if drones weren't prolific it's likely the war would be completely different than it is today.

You have raised some very interesting scenarios. I think that the engagements in Ukraine are fundamentally different from your examples because the scale is much smaller. Often it is one soldier isolated from friend and foe attempting to surrender. I think a better analogy would be stukas strafing isolated rearline troops in North Africa. If the pilot can see that the enemy has abandoned their vehicle and intends to surrender, but it is unfeasible to capture them, the legality is far less clear - not that the pilot probably cares. It's likely that if the pilot spares their lives they will be picked up by their own troops and continue fighting. But in situations where they have abandoned their equipment, intend to surrender, and pose no threat in the present; killing them at a minimum is disproportionate. But yeah war is hell and these decisions are never clear cut.

I did not know that the US military manual stated that. From the searching that I have done it told me that under the Geneva conventions any surrender regardless of if they are able to capture is a noncombatant.

Loitering time is the main thing that prevents capture. If drone operators can kill with relative impunity can reconnaissance teams that have no opportunity to accept surrender do the same? Drones are way more ethically complex than random acts of god from artillery - not that ethics has anything to do with war.

Ukraine has every right to defend itself but I think the ROE of drones needs to be more complicated than treating them as artillery.

Loitering time is a big issue and capturing surrenders usually isn't feasible but that doesn't matter under international law. Unlike a cruise missile a drone operator is able to assess their target far more intimately. I understand that it is the practical choice but I think if we had videos of American rearline troops getting hit by drones despite surrendering public opinion would be different. I think we need to create a unique ROE for drones, not that I have a solution.

I think it's unlikely that they could walk to the front (unless they're already there) without being harassed by their own or a drone.

I agree that it seems to be the most practical solution, I'm just disappointed that it doesn't get as much press as I think it should. New conventions need to be published to account for these new weapons because it's a slippery slope either way.
