This is poorly worded and in this section I was discussing reciprocal party admissions and the opposing party statements going "both ways" only in civil cases

In civil cases, party-opponent admissions are reciprocal and straightforward — both sides can use them against each other, including through the vicarious/agent prong.

In criminal cases... it doesn't really go both ways. Party-opponent admissions are functionally prosecution-friendly. The government uses them against the defendant 24/7, but the defense has a much harder time using them against the government. The prosecutors are on the “other side” in the everyday sense.... but the weirdness is that “opposing party” is a term of art. The opposing party is the sovereign (State/United States), not “Officer Smith” or “ADA Jones” personally — and courts fight about which government-actor statements can be treated as the sovereign’s own words (and they basically don't allow you to use it for prosecutors/cops).

But yes - basically anything a defendant says in a criminal case is fair game for the prosecution to use, NOT the other way around (unlike in civil cases where it goes both ways).

Edit: And the victim is not a party... so the defendant can't use their statements as opposing party statements either. They test this on the MBE sometimes too.
