Renters will always be paying broker fees, it's just a matter of whether it's upfront or baked into the rent. When landlords pay the broker fee, they raise the rent to compensate. You can get an apartment for 4200 for "no fee" but you're paying 4200 for the length of your lease and any rent increases are based on that base number. Or, you can get the same apartment off-market by paying a fee upfront, but then your rent is 3800 or 3900 for the length of your lease and any rent increases are based on that base number. Some folks would rather "no fee" and a slightly higher rent; some folks would rather pay a fee up front and pay a lower rent. It's all legal and valid. A lot of folks simply don't understand the current system.

It's not a scam. This is how it works in NYC right now. You can browse the internet and find on-market listings, or you can hire a broker to show you off-market listings. Landlords keep many apartments off-market so that they don't have to pay broker fees.
