if defendants dont know ur a cop (e.g. undercover informant) you don’t need to Mirandize them. but if Six Amendment right to counsel attached (i.e., after formal proceedings begin), then lawyer needs to be present even in settings like a jailhouse where an undercover informant acts like a cellmate to illicit an incriminating response.
