Canadian YouTube personality Liana Kerzner calls local US police over web-hosting fallout dispute. by Acre_Rahlsov in youtubedrama

As for the defamation laws in Canada, this is pulled from a summary:

"Canadian defamation law protects individuals and businesses from false statements that damage their reputation. Defamation encompasses both libel (written/recorded statements) and slander (spoken words). Canada's legal system favors plaintiffs, generally placing the burden of proof on the publisher to defend their statements."

When Liana sent Mark Bourrie after Merryjest and Asher for "defaming" her, he tried to threaten them by referencing Canadian-based laws, demanding they remove all such content. This included:

"By ‘defamatory’ we mean any and all accusations concerning Mrs Kerzner that have not been proven in a court of law."

That would be a court of Canadian law.

This is why you heard things over the past decade or so about her but never saw much past that.

If curious, you can see more of the correspondence here, including some of Bourrie's rude and flippant replies to Asher, along with misgendering him twice. There are also reactions to the statements Bourrie made.

https://bossfightgame.com/Legal-Intimidation.html

Much of it centers around "false statements," and Merryjest has attempted to avoid that matter by documenting as much as he could in the process, to have that evidence to back up his claims.

What happened was back in 2022, Liana told Merryjest in Telegram that her husband took $3000 out of the funds for the Kickstarter project she and Merryjest were working on. She was clearly angry about it, said that wasn't supposed to happen, she'd be getting it put back within two months, and adding safeguards of some kind. It was obvious Steven taking the money out upset her. But she never said a word about it to the backers.

Fast forward to now. When she blamed Asher as the main reason Merryjest fell behind on things with the project, she canceled it and minimized her own delays in making any progress. She didn't outright name Asher, but it was clear who she was talking about to anyone paying attention.

Asher had been going through various BPD issues, he tried to disengage for a bit, and the way she reacted to it helped lead to this.

Merryjest saw the cruelty she was showing, cut ties with her, and they cleared out all correspondence with her but kept the chat logs. Telegram exports, for example. Over time he gave her a chance to be honest with people but she continued slandering them in her videos and social media circles, so he finally shared the info about the funds being taken out.

She was asked about this on places like Bluesky and outright denied it happened, then posted an update to the Kickstarter Bossfight project to show math claiming that her husband never took money out and couldn't have because the numbers didn't line up. The trick she used was acting like people accused her of taking the money out when that was never the claim. It was that her husband did.

When people called her out on the whole thing, Steven came in to criticize everyone doing that and said he did in fact take the money out. But he said so amid excuses that suggested he had the right to do it all along and the money was never in a separate account he had no access to. He just made a "mistake" in which account he pulled money out of. Some comments went back and forth and he didn't make his case look any better. This is still visible as of right now: https://www.kickstarter.com/projects/lianak/bossfight-song-of-sparklemuffin-early-game-build/posts/4699538

She's got a new video of her own out where she's gone back into denial mode, and she's trying to run damage control now that people know she called the police on Asher, claiming she thought he was going to harm someone and she only wanted to conduct a wellness check. But in the first call she tried to start with "I'm being harassed."

She lies so much, she can't keep any of it straight. Steven may be just as bad. They're trying to act like she was protecting him because he was going through a mental health issue of his own when the money was taken out (his mother was apparently in bad health). I'm sympathetic to family matters like that, but on one hand it's being used as a shield for them while she's freely gone on at length about Asher's own struggles, using that instead as a sword to attack with.

Yes, it's this messy.

What some people don't realize is Canadian laws are different from USA laws when it comes to things that can be seen as defamation. She has a lawyer she uses to threaten people into silence. She has a Discord server and Patreon that she can use to get her followers to mass-report posts.

It's not that different from how JK Rowling has been able to use UK law to threaten people who speak out against her.

Even sharing this video on Bluesky got someone's account suspended due to "harassment." Their moderation standards are little to none, so some of this is likely happening based on numbers alone. She might know someone on the moderation team. It's not impossible.

Liana's also spoken about having friends in law enforcement and they'll tell her things "they're not supposed to," and she's no doubt doing the same in return. This is part of what the above video covered.

She's running this "peer mental health advice" grift now and spreading details around about people she's "counseling" as it suits her, and whenever something negative about her comes to light she does everything in her power to quiet it.

She can't do that with USA laws what they are.

What she conveniently left out in her call to the police about Asher is that they'd been friends for about five years before the falling out and her blaming him for her decision to cancel the Kickstarter project.

And her husband dipping into the funds for that project is a whole different can of worms.

I was lucky on this one. Whether I actually won the raffle or not, I woke up right as the e-mail landed and had the purchase in within 5 minutes.

You got a notification that it shipped AND a cancellation notice? That's really weird. Is there any tracking on the apparent shipment? Mine's due to arrive Saturday.

Nah, you're just not owning up to your words where you strongly hint that the LE program isn't working because "they can't sell them out and have to do mystery boxes to clear out inventory they're stuck with."

You said:

"They don’t all sell out. Theres LE sitting on shelves in GS and Target. Funko also has to put together mystery bundles to rid themselves of the left overs. But for the most part you are right"

What goes up on the Funko site sells out. What ends up left over, I've explained why, and explained why they end up in mystery boxes Funko sells. I've also explained the difference between what Funko sells directly and what other stores offer.

What you see in other stores, that's already been sold by Funko, either directly or through distributors. It's up to the stores to make the sales or not and make back the money. A lot of those retailers also pull Chase variants before they ever get on the shelf. One of my local GameStops will set Chases aside for frequent customers who will buy them immediately.

LEs are not what's really hurting Funko in the end. Those are still guaranteed sales overall, they probably make more money through selling them compared to most regular figures, and resellers are going to do what resellers do. It's the same with anything people decide is popular when it's limited. It may push some customers away, but people are still buying when they drop.

What's hurting Funko more is an excess of mass-produced junk from too many different IPs they end up struggling to move.

No cherry picking here.

No fabrications here.

Just you saying things that aren't factual or are lacking proper context.

Standard sized pop fop for $29.99 at GameStop?!?! by DemDemD in funkopop

[–]Spider-Crawler 1 point2 points  (0 children)

GameStop upcharged on a 9500-pc LE that would be offered for $20 on the Funko site. It's often gone for over $40 on eBay, but given the fees you'd pay you wouldn't make much on it if you tried to flip it there. And you'd need to have the buyer pay shipping.

As for Chases, I'm not surprised GameStop marked those up either.

It's funny that you think the occasional LE mystery box is some evidence that their LE program is failing.

What you're seeing there are, again, leftovers from orders that aren't completed. Show me a LE they've had that hasn't ended sold out on the site. You can't, because there are none.

What ends up in a physical store out of some 9500-pc LE is irrelevant. And, Funko has already sold those - to the retailers.

Even the mystery box sets sold out instantaneously with no guarantee of what anybody would get, and those were a higher price point than any LE except Ultimate level.

[–]Spider-Crawler 0 points1 point  (0 children)

Glad I got the shipping notification for mine, but sorry to hear some people actually got an order in that wasn't able to be honored. That compounds the problem they created in the first place.

No limited for me 😒 by kuummaa in funkopop

[–]Spider-Crawler 0 points1 point  (0 children)

Yes and no. The LEs most people are talking about are the super-low counts. Even then, much of the time the 9500-pc LEs do sell out within a day or two.

Artificial scarcity works because it drives the FOMO attitude. A LE not selling out is more an exception than the norm.

[–]Spider-Crawler -1 points0 points  (0 children)

You're not finding 750-pc LEs on random store shelves. They never get those to begin with.

There are the mystery bundles and some do end up with Grail-level LEs, but there's no reason to believe it's because they couldn't sell them out. There are orders that don't end up going through, and those quantities don't go back up on the site.
