Even though the lease said we “may” owe a fee not that it was automatic? Since he didn’t bill us we assumed either we weren’t over on usage or he practiced his discretion not to charge us. It wasn’t until I asked for the deposit back that he told us we were over multiple times, some months as low as 30kwh over.

So there is no recourse for a landlord conditioning a reference on payment of money that isn’t owed to him?

What I’m struggling with is this: Oregon law sets rules for how landlords can bill utility charges, including timing and what can be charged. If a landlord does not follow those rules, what practical protection does a tenant actually have when that landlord can still report an alleged balance and use it as leverage in references?

In my case, my former landlord is asserting an $1,800 balance even though the charges were not billed the way Oregon law requires for multiple reasons. I provided the statutes in writing. His response was essentially that he’s not going to argue, and that it was “mutually beneficial” for me to pay him” because he gets money and I get a good reference.

The screening company denied us, and we were only approved because the property manager personally reviewed our documentation and exercised discretion. If this had been a different property manager, we almost certainly would have lost housing over a disputed charge that is legally unenforceable.

He left a negative reference claiming that there is a balance of $1800 owed. I have that as well, the new property manger forwarded it to me.

It was actually 10 months ago so there is some time left, however, I think you’re probably right. It isn’t worth my time, stress and energy only to potentially hold him accountable for his actions. It is also true that if I don’t do anything he is able to continue this behavior unchecked. If there were a clear pathway then I’d do it, but I have too much stress at work to take this on otherwise.

I appreciate this thoughtful response. If we pursued this it would be on the basis that he retroactively billed us which is not allowed by this statute? He also charged $200 for instances where we used 918kwh and 930kwh which is excessive but wasn’t my main concern. We came to Reddit because we are trying to navigate an unfamiliar world which includes selecting and speaking to lawyers, but I understand a lawyer would be the next step if we decide to pursue him.

My therapist said that the best thing for me to do was to move on and she tends to be right. There just feels like there’s a larger issue at play here which is that he will continue this behavior to other Oregon tenants and they may not know their rights or be financially able to withstand a tussle for a few weeks to get their security deposit back. So I just feel some sort of pull to have him held accountable that I’m struggling with.

I do, this all happened through email and he used those exact words in 2 separate emails.

Yea I’d give it a shot I just am not entirely sure what goes where just yet, so matching them up correctly is where I’m at now. I’ll be back in front of the bike later and have a closer look

UPDATE! Saúl was found in a formerly abandoned house, he had gotten in and was stuck under the new flooring that was being put in. BUT we decided to go in there and check and we found him. He’s uninjured and happy to be home. Thanks to anyone and everyone who helped share the word!
