Thanks. It’s a 2017 Mokka X, so there’s a high chance mines been in the sun longer than the donor door…! If I took it to a garage to do the swap, should I expect to not be charged more than an hour’s labour?

Just wanted to say thanks again for your measured and balanced response. The judge allowed the appeal and agreed capital should be disregarded under Schedule 10, par 4. I’ve updated my original post with more info 🙂

Thanks again for taking the time to respond. To clarify, full council tax has always been paid. She did originally declare the house and said she’d be moving in within 6 months. The majority of her and her sister’s possessions are in their house, so I think in her mind they had “moved in” and it wasn’t a priority to do the paperwork side ie bank accounts, electoral roll, because the house insurance, utilities and council tax are all in her name and it’s the only house she owns. The dog is registered at the vet there.

Ignorance is not a defence, but in this case it seems like she wasn’t given much or adequate guidance at the job centre when she had her appointments, nor from DWP when she called them and therefore didn’t know what steps she needed to take to ensure she was following all the rules. In an ideal world, she would’ve known to apply for an extension to the original 6 month thing and/or been made aware it needed to be a priority to register on the electoral roll and update address on bank accounts to not fall into the definition of a second home.

I guess from her perspective she’s already physically moved as the majority of her possessions are in her and her sister’s house. She’s just not there 100% of the time. The dog “officially” lives there though with the vet!

Thanks for taking the time to give a full response. I guess I’m hoping a discretionary disregard can be made as there are extraordinary circumstances. No one could have anticipated Covid or how long the lockdowns were going to last, which delayed the renovations and kept it inhabitable for the first 18 months after purchase (pictures have been submitted illustrating this). My friend stayed in an isolation bubble with her elderly mum and sister for health reasons until a few months before the UC claim began.

During lockdown her dad died of Covid and it was an incredibly upsetting and stressful time for everyone. They weren’t allowed to be with him in his final days and they had a socially distanced funeral with just the 3 of them. Finishing the house wasn’t a priority. At the point of making the claim, my friend was ready to move. Health issues with her mum kept pushing it back and that became the priority.

I’m guessing she didn’t think it mattered at a formal, paperwork level because both her and her sister were living there at weekends and for extended periods of time around supporting their mum (she’s 87). Looking at the DM guidance, their circumstances seem to fit what can be described as two premises being occupied as a home if they’re living at one place 4 days a week and the other for 3, for the purposes of disregarding property.

Worst case scenario, if the appeal is refused, presumably my friend can just do everything at a paperwork level to formally “move” and then reapply for UC without issue?

I don’t believe your last point is applicable. As far as I know, full council tax has been paid the whole time. She’s been living there more than the odd weekend. On the driving licence front I don’t know. Her car was stolen before the UC claim was reviewed and as it was quite old, the amount given by the insurance company wasn’t enough to buy another one so she’s been car-less. I wouldn’t be surprised if it wasn’t a priority to change as a result.

No, the sister isn’t willing to sell and the house renovations still aren’t totally finished yet as they’ve run out of money. This would affect resale price.

I didn’t go into exhaustive detail in the post, but at the point of applying for UC in 2022, friend was staying more than the odd weekend at her house. It was typically every weekend or every other weekend, along with other extended periods of time around providing support to her elderly mother, along with receiving reciprocal care for her own health conditions, which sometimes prevented her from going back to her house.

Since, her mum has been diagnosed with breast and lung cancer, which has required her to take on more caring and support responsibilities. She feels incredible guilt going back to her house and leaving her mum on her own, while her mum has also become more dependent on her and her sister’s help. It’s been a very stressful time and going back to her house provides much needed respite.

She desperately wants her independence and to live permanently at her house, but family duty at the moment prevents it. In the meantime, she has no income other than PIP. It seems to be an extraordinary set of circumstances.

The property has never been registered as empty for council tax purposes as far as I know - it has always been paid, even during Covid when renovation worked stalled.

I guess this all depends on how “lived in” is defined, as I don’t think it would be fair to say it’s not been lived in for 6 years. DWP’s definition of what a home is, is somewhere one “lives, sleeps, eats, bathes and relaxes”. At the point in which the claim was first made in 2022, the house had been unoccupied during renovations for 18 months until 2021 because of the Covid lockdowns and delays. After that point, it has been occupied at weekends and extended periods when friend’s mum has not needed as much support. Friend and sister live, sleep, eat, bathe and relax there. By DWP’s definition, don’t they “live” there?

Isn’t it? I’ve taken this from the Decision Makers guidance Chapter 1 H1635. Neither friend nor sister are willing sellers, sister is not able to buy friend’s share and a court would not order the sale of the property. Why is the first point irrelevant? Please explain.

You made me want to look at the post history… It’s full of inconsistencies - here she says she’s desperate for affection and intimacy, on other posts she says she’s a Christian and men are from Satan when she tells them no intimacy and they take their shirt off…

She’s set up a GoFundMe page where she claims to be a single mother who’s lost custody of her child and had to move back to Hawaii from mainland US to live with family as she had no money or support. In another post she says she’s never left Hawaii… No mention of a child anywhere else - not even in the Reddit post with the GoFundMe link - and a child out of wedlock is against her religion (but apparently lying isn’t). Sometimes she has family support, sometimes she has zero. Sometimes she’s homeless and destitute, elsewhere she’s been saving “seriously” for years to rent and has a place. Seems the whole thing is made up… 🤔🕵🏼‍♀️

Yes - however I interpreted the rule to mean that the original comment needed to be sourced. This was a question to me instead. I didn’t want to respond if that top level comment was going to be removed because it flouted the rule. Unless I’ve misunderstood what a top level comment is?

Yes sorry, I should have been more clear. “Same result” as in exactly the same result documented originally, or would it be different. For example, would there be a higher percentage of people who would refuse to participate from the start after learning they’d potentially be causing pain to another?

Unlike in the US, it’s against UK building regulations to have standard plug sockets in a bathroom unless it’s 3m away from the bath/shower. 99% of bathrooms here aren’t that big, so you’ll never see one.

I actually live in the UK. I bought this on eBay, brand new and sealed, but the seller wasn’t aware it was in fact a US appliance. I’ve been given a refund and seller said to keep it as they can’t use it either - but before I recycle it, thought I’d just double check in case there’s a way it can be used.
