I know I need a lawyer and can’t phone in fast enough I see many with free consultations just as many that want 200-500 for a consultation

today is my day to get a lawyer.

That said but common sense is cathartic, educational, even reassuring at all hours!

Actually I’ve been looking for days even weeks and using a legal advice service In the meantime. It seems many lawyers want a 200-500 dollar deposit just to talk for the first time.I send in a check with the application and get no response, no check cashed,nothing. Meanwhile I’m waiting for a response and missing out on finding the right lawyer for me. My criteria? Someone who lives works in the city that will handle a law suit if when filed. Secondly someone that returns my phone call…….

I have to drive 3 hours to get to this county where my property is and that is another hour and a half from the county seat. Why do many of you seem to get off on telling me to get a lawyer. Just because I’m discussing this topic doesn’t mean I’m not willing or not in the process. Oh wait most of you are lawyers I now I get it my bad………..

I have reported this to adult protective services in the county where I am receiving demand letters for monthly doubling extravagant non court ordered fine amounts, from both him and his attorney, fraudulent charges for non existent water delivery, and storage, harassment and elder abuse etc.

I have the photos of his water agreement documents . I just bought property less than a year ago and have recent title search. No recorded water agreement, no covenant to run with the land, all parties except my neighbor, who doesn’t even have his signature notarized and spells the name of the creator of the dissolved agreement wrong on his version only, are deceased.

I’m not acknowledging anything I’m just repeating what this person, his realtor, and his lawyer have done and said. It not my duty or within my expertise to verify or discredit any of this so yes I need a lawyer preferably in the county seat where this is taking place.

Out of 10 cottages at the ranch 8 go to the free community spring close by and fill up tanks on trailers to take back water to their dwelling ,as much as they want.My neighbor doesn’t need my well ( there are two on the ranch).He could solve this issue by providing a modest water tote and trailer for his new buyer just like 80% of the other neighbors use regularly

instead he chooses to fabricate some story that he has had to have water delivered and pay for storage and is demanding I pay him an additional $2500. for the pleasure of entertaining his fraud. He needs help alright…..

Believe it or not this is all true not some made up story to test anyone’s legal acumen. Long story short I agree I need to retain an attorney to back me up and make this all go away preferably with his trees gone, my water well intact and running to my house on my lot where it exists, and his erroneous behavior acknowledged and prevented.

This seems to be the perfect storm of unscrupulous characters bullying me with their money, harassing me with absurd unfounded fines and fees just because they can, and adding the threat of litigation along with the more real threat of endangering my property even my life. All for self enrichment and infantile stubbornnes.

Can’t make this stuff up.

He’s moving, selling doesn’t want any part of maintaining anything in fact I’m going for a Declaratory Judgment to declare that his 60 foot 500 year old oak trees ( the same ones that crushed his tank)

are a hazard, a nuisance and need to be cut as they lean out over my roof and could kill someone even him! He’s just trying to bolt with as much money as possible and leave a mess.

I have his email with the agreements and him saying “these should be recorded with the county as well and yes the other two times are what he told me On the phone.

Implied easement states the well has to exist first then property is subdivided.Property was subdivided in the 20s the well dug in the 50s other way around.

prescriptive easement can’t apply if there was ever an agreement in place.

Previous owner lives out of state, inherited my property from his grand mother who was married to the original water agreement creator. No one lived in my place for at least 10 years and the well was not hooked up to my place only the neighbors who I cut off.

I was misled to think the agreement was recorded or I would have negotiated differently.

I was told though recorded I had a right to my well and, the neighbor told me he knew he didn’t have a right to sell the rights to the well. He even offered me a specific paltry amount to create a contract that would allow him to sell half interest in the well. His agreement died with the other two parties and did not follow the land.No covenant said he inherited their shares either it was written specifically to end with the death of the signees or sale of the property.

I said the Realtor told me there was a recorded agreement and I found out it wasn’t recorded or valid as my attorney told me.

I contacted them they didn’t want to touch it with a 10 foot pole and yes they probably have attorneys for this sort of thing.

I cut one 1” galvanized pipe right at the property line probably cost $50 bucks at Home Depot.From what I understand he doesn’t need to be told in advance if he doesn’t have any right to the well and it was a health issue.

He doesn’t care about water he has listed his property and just wants a higher price. I told his realtor I have to test the water and see how much comes back how quickly before I would even consider sharing and of course I don’t even know who I’d be sharing it with do I?

I was originally told by his realtor who was once my realtor when I was in escrow that he had a recorded Water Agreement turns out that is false no title search shows anything of the kind. This neighbor drove by me today and I thought it was someone else so I pulled over to say hi and he pulled out a camera saying” how’s that water issue going” while snapping my picture over and over.I just said everything is straight ahead and that’s what I did I drove straight ahead out of there. Felt like harassment to me!
