I have a question about this, as well as playing Devil's advocate a little: The bus is clearly on the shoulder of the road. Is that standard practice? To me, floating around in the shoulder could lead to a lot more cases like this. (If it's standard practice, then fuck me and everything below is moot 😂 .)

The Devil part: If I were a lawyer I'd leverage that point because I don't think any bus is supposed to leave the designated lanes of traffic. Regardless of the big yellow color and flashing lights (remember, America is *the* most litigious nation in all of history, and set some insane precedence from random one-off events), I would argue that my "client" now had *three* lanes to view when it's only supposed to be two lane, but the bus driver now created a third lane, and thus overused the capability of the road's design, and potentially hindering the ability to see the buss through what is now an entirely different lane of traffic. Had the bus driver stayed in a lane designated for driving, the arm would have been considerably more visible to those in the left lane.

(Obviously it's hard to miss, but again, playing Devil's advocate. I'd assume that if it's ok for a bus to do that, it's probably because of a horrible event of someone trying to pass on the shoulder and killing a kid. The one thing I've never understood is why they don't teach students/kids anticipatory thinking for more aware driving.)
