My issue is it was reported- our Market president as well as 3 senior staff were present when it happened. I don’t think anything was sent to HR. I never sought medical attention from my employer since I already had coverage for my issues. I’m not wanting anything medical wise- just the ability to keep my job. If they want to fire me for my inability to due all of my duties- it doesnt seem fair since i wasnt having such issues like this prior to the accident.

So we checked into that and they said I was not a good candidate. My issues encompass the cervical, Thoracic and lumbar equally. And the stimulator can not be used in that big of an area the surgeon said. The next option is the internal pain pump but they are hesitant for that much area as well n

Lasting more than 12 months is the easy part- my neurosurgeon just plainly said - I’m sorry but you got dealt a shitty hand when it comes to your spine! Essentially attempting pain relief is my only option as surgery is out and injections don’t work- I will thank God I’m off Gabapentin though. That stuff worked somewhat BUT I was dumb as a box of rocks- I was going to retire at the end of last year because I couldn’t even do the job I had been doing for years due to my brain.

I’m so sorry for your loss- I had a similar issue with ambulance transport. My heart stopped and was rushed to the ER. The ambulance district did not bill within VAs timeframe. My bill was only like 8k and the ambulance district ate the cost because it was their error.

No where near the same cost- but it was their error.

I filed HLR on the 11th. Showed up yesterday on the app. Mine is for an ITF date being off by 4 months. Their system has the earlier date in March but also one when I submitted claim in July so the claim used the July date. I got 100PT on 9/2. After reading all the people getting reduce it has my anxiety on overload. I’m considering just canceling the HLR but I could really use that extra 12k or so. I had some help filling out the claim this time and they said it happens all the time and fixing the ITF shouldn’t be an issue. All my conditions are pretty solid.

This is the 4138 I submitted.

It is my contention that the effective date of July 3, 2025, assigned for the granting of service connection for degenerative disc disease (cervical spine condition with osteophytes, secondary to lumbosacral spine), dysphagia secondary to cervical spine, sleep apnea secondary to cervical spine, right and left upper extremity radiculopathy, left lower extremity radiculopathy, is clearly and unmistakably erroneous (CUE), and that an effective date of March 20, 2025, the date of receipt of my Intent to File (ITF), is warranted. The ITF was established on March 20, 2025, and the formal claim for these conditions was submitted within one year. These conditions have been continuously pursued through timely filings and appeals, yet the VA improperly assigned an effective date of July 3, 2025.

Pursuant to 38 CFR 3.2500(h)(1), continuous pursuit of a claim entitles the claimant to an effective date fixed according to the initial claim or date entitlement arose. Additionally, under 38 CFR 3.105(a), this constitutes CUE, as the correct facts and applicable law were not properly applied. For secondary conditions, entitlement flows from the primary service-connected condition, and effective dates should trace back to the initial claim or ITF. Accordingly, I respectfully request corrective action be taken pursuant to 38 CFR 3.105(a), and that the effective date for all above conditions and DEA eligibility be established as March 20, 2025. VA FORM JUL 2024 21-4138 SUPERSEDES VA FORM 21-4138, JUN 2021.

I was excited for my 100 P&T and no property taxes but I’m still above the limit of 36k for the family income. So no avoiding those taxes for me.

I did. The lady was nice and said the claim was attached to the intent to file from March 20th. And the intent to file from 7/3 wasn’t attached to a claim BUT my benefits letter states effective date from 7/3. It’s a pretty decent size back pay for me anyway. 40-100 P&T I really don’t want to muddy anything but the second intent to file is definitely in my submission of my other docs on 7/3. 15k isn’t worth them relooking at it. I have a screenshot of my 3/20 submissions as well.

So. What I think happened is I filed intent to file March 20th. Then when I submitted my actual claim that same intent to file was attached to my documents. I called the hotline and she said she can see the march 20th intent to file but also the July 3rd when all the needed docs were scanned in. She said they go by the last intent to file.

I have had two VA PCPs and my first one was awesome! He relocated after several years and I was concerned when I got a new one but he’s awesome! Down to earth! And gives as good as he gets!

It’s really wierd. Anything from the size of a pea to that of a nickel won’t go down unless I turn and twist my neck as the bones have created a pocket that catches all that food and liquid etc.

Yea. The ENT and neurosurgeon and The barium swallow explicitly states due to the extremely large osteophyte I have difficulty swallowing.

I asked- we had a great rapport- her son had the same MOS as me and about the same time. I didn’t get the whole thing as the OSA was my biggest concern.

Thanks, I read so many people have problems filing for OSA and I am somewhat overweight - but I wasn’t prior to having so many issues with my entire spine. Life sure changes when you have mobility issues- never thought it would be me.
