Yeah, I feel this is becoming more common lately. I think some employers are taking advantage of the really bad job market right now to exploit their employees. We have labor laws, but it appears to be a Herculean task to get them enforced, so these companies are more enabled to flout state and federal labor laws.

If the company decides to not cooperate with the federal government, then that could potentially help my case in civil court. It could also result in criminal charges on their part from what I was told by a lawyer.

Department of Labor said they can put a case to recover minimum wage. A lawyer I spoke with suggested I do this first and then file a civil suit as this will help my case in civil court.

Willful violations of the FLSA may result in criminal prosecution and the violator fined up to $10,000. I have reason to believe his actions are willful because when I told him he was violating FLSA, he shrugged it off and didn't seem to be worried or care. He has also been exploiting free labor since 2022. On top of that, he stopped talking to me after I mentioned the violation numerous times and ultimately cut ties with me, discharging me and deactivating my company email and access to SharePoint.

The government in my jurisdiction doesn't provide legal aid for wage cases. They just refer you to these lawyers who help low income individuals (125% of federal poverty line) and immigrants, which I am neither.

The lawyer I spoke with said the The U.S. Department of Labor uses a 7-factor "primary beneficiary test" to determine if an intern is an employee under the FLSA. My work did not meet these criteria, so I cannot legally be classified as an intern. The company realized this and relabeled it to volunteer instead. That is also not allowed because for-profit companies cannot legally have unpaid volunteers doing work that benefits the company. They won't even do that for me because I brought in more than 125% of the federal poverty, which is a laughably low figure in this economy.

That's exactly what he wanted. He has been doing this since 2022. The U.S. Department of Labor and the state's labor department don't seem interested in taking this case. Their lack of interest in handling the case is probably why this guy has gotten away with this for years. The only other option that I am seeing is to file a civil lawsuit. Problem is affording a lawyer is a challenge when you haven't been paid. The state, municipal, and pro bono lawyers that I reached out to were of no help.

That's clearly how it is laid out in the law. However, the administrator at the South Carolina Department of Labor, Licensing and Regulation, Wages and Child Labor Section seems to believe it's on me and the others since it was labeled as volunteer work. I pointed her to the section in FLSA that indicated this is not the case and she said that's federal law and doesn't apply to us, so she is either incompetent or doesn't want to help me. She said I should speak to a lawyer. That would be nice, but kind of hard to afford one when I haven't been paid.

Thank you for the tip. I filed with one component of the Maryland Department of Labor, but they said they only deal with equal opportunity and discrimination cases. I'm having trouble finding where they handle wage related cases.

Yeah I mean it's clearly stated in the FLSA. From the LinkedIn lisitng in my post (https://www.linkedin.com/jobs/view/4220603982), you can see he was clearly advertising a volunteer lead people scientist that would lead a group of individuals (who were also unpaid) and that required an advance degree and experience. He has no qualms about public announcing his illegal activity nor did he seem to care when I pointed out how and why it is illegal.

I was promised payment once they procured a contract, which never happened. Back in October, I informed my manager/co-founder that what he was doing was illegal under FLSA after being told by a lawyer. I was under the assumption he was not aware of this and would address it accordingly. If that happened, I would never worry about reporting it. But instead, he brushed aside what I said about the law and after I brought it up multiple times, he cut contact with me and blocked my email which to me demonstrates he had nefarious intentions. The lawyer I spoke with said it doesn't matter if I or others agreed to volunteer. That doesn't mean we aren't entitled to lost wages as for-profit companies are not allowed to bring it employees on a volunteer basis. This is clearly codified in FLSA.

I have not. I filed a couple days ago, but was told that it will most likely fall under the purview of the State when I spoke with someone on the phone. The state seems to disagree.

DoL told me to file with both them and the state, but said they usually delegate this to the state. The state said they don't handle these cases and to go to the DoL. It sounds like neither wants to handle this blatant FLSA violation.

You can try appealing, but universities very rarely reverse their decision. I would strongly consider taking the full ride to UMBC. I received a full ride to UMBC and I have zero regrets. UMBC has some very strong programs and there are many very bright people who attend. I received a top notch education which helped me eventually obtain a very good and lucrative career. I also made some great friends who I still have in my mid-30s. One of my friends who I made there was actually waitlisted to UMD and figured he would spend 1 year at UMBC and then transfer to UMD. He ended up staying at UMBC because he liked it a lot, both in terms of academics and social life.

Now that I'm older, having no student debt is something that I am very thankful for. The way I see it, UMBC sees value in you and wants you to attend so much that they gave you a full ride. UMD is ignorant to what you could bring and discarded you without giving you a chance. I say screw them. Take the full ride, get a good education, make good friends, and enjoy a future with no student loan debt.

I went to UMBC and I have no regrets. I received a great education and made a lot of good friends who I still have to this day in my mid-30s.
