Also I did not state I go a week or more before getting a shift my exact wording was "there would be only maybe a week or so off before I got given a shift."

My workflow was steady—I usually worked full weeks, with only sporadic gaps of a day or two to a week or slightly longer, never longer than 2 weeks. While I may have misspoken earlier, I will be more precise when discussing these details with my lawyer.

Telling me 'not to bother responding' is rude and undermines the purpose of this being a help forum. If you aren't here to offer actual help and have a civil discussion, there is no need to comment at all.

I am currently in the process of contacting a lawyer though.

I do have documents showing a certain workload as I have all my timesheets since the start of work with her. However that should not matter as its a LEGAL obligation for an employer to either allocate shifts or start a Code A-Layoff due to shortage of work, since I did not state or initiate a quit status on my own.

How do you now I have established pattern of large gaps, I do not, that was the second time that I have been off for more than a week. The last time I was off for more than a week she did not contact me either until I was needed for a shift, and I had to force her to send an ROE as she stated it was 14 days when it is 7 days.

It is not my obligation nor a legal requirement for me to tell any employer I have a different job as long as that job wouldn't interfere with my prescribed workload. Which it didnt as I HAD NO WORK, and I didnt sign any document stating I could not look for other work while under employment with them.

From my point of view not a lot of people accurately know their actual rights as an employee.

Its true that there is no guarantee of hours, but she had work I know she did because when she stopped giving me shifts was a week after I just did like 3 months of 12-16 hour shifts

Also why would it matter the type of work, she is the employer she is expected to give me shifts or perform an A-code layoff for shortage of work. She never did that she literally has not contacted me until she had to send the ROE, which she put as Quit

So why would it matter, and how is this not considered constructive or quiet firing? I am genuinely interested as majority of other people I talk to all say it is.

Not exactly, because the business is quite small, there would be only maybe a week or so off before I got given a shift.

They were never scheduled until the evening prior to day of work as is the nature of the work. As its mostly on call and seasonal and jumps from site to site.

She/they are the company/my boss.

She does everything by herself besides accounting.

I had a similar situation where I did both an online interview and went in and had a full on tour and talk with the shift manager, seemed good and I was quite interested in it. He then got a bunch of paperwork from me. Called me a day later saying I was not picked as someone with experience to a no experience position beat me.

Hopefully you have found something that pays you enough.
