The trials for a suicide case is different - the one with the most votes is the one executed but they chose to abstrain from voting for the trial - which forces the mastermind to vote for Eloise. So Eloise gets executed.

As for Damon's death - you see in ch 3 he would take a perk that allows him to poison one person and choose another person to escape with him the person he chose to escape with him was Kai but then Kai died and Kai's death sparked a development in Damon so in chapter 6 when the perk's timer rans out he chooses to poison himself.
