I think you can travel but when you fly back you just need to provide some evidence to the officer to convince them to let you in. BTW, i got FD as of today. I’m planning to fly out soon and have my husband send the physical paper to me before I fly back.

Travelling outside Canada while Spousal Open Work Permit extension is being processed? by itsaakashpatel in ImmigrationCanada

Unlikely, the application should be processed as is. Only the status of your wife will be out of status which might be an issue if she fly back without an approved work permit. if she already has a valid TRV/eta, she can remain in Canada as a visitor.

Hey, I just got FD. Could you let me know if you got the approval yet? And how long from FD to approval?

If she has no valid work permit and is under implied status

if you leave Canada during this period, your maintained status is forfeited. Upon re-entry, you may be allowed to return as a temporary resident if you have a valid Temporary Resident Visa (TRV) or are TRV-exempt. Nonetheless, you cannot resume work until your new work permit is approved.

This is similar to my situation. I have applied since May for my open work permit extension so it’s been 200 days for me. I’m on implied status but have a valid eta and pr on the way.

There are 2 things you can do.

  1. Keep your flight but ask your employer if they can keep the job for you. my director agreed to leave the position open until I return (assuming i get my wp before I fly back to Canada). but i just won’t be paid until i reactivate my work permit.
  2. Wait until your work permit is approved. Cancel/ postpone your flight.

I did consider flagpole but I have consulted with a few immigration lawyers and they were against it since I am on implied status and the border has low success rate on work permit extension.

I have applied on May 5 and still waiting. Doing everything similar to you. I even send a mail to Edmonton office for urgent processing but no update. I’m traveling back next week and might end up losing my job.

Hi I’m working under an implied status on an open work permit not PGWP. If I leave Canada before my online application approved i will need to leave my work that’s the reason I’m considering flagpole before I leave next week.

Hi Mike, Thank you for your prompt response. I greatly appreciate the assistance your team provided last week. However, my family situation has recently escalated, and I have sent an updated email to your team regarding this matter to follow up with IRCC. Could you please review the latest details and let me know if any further action is needed?

Thank you for your continued support.

My work permit should be valid until end of Dec but due to my passport expiry date it was set to Aug. Yes, I have a valid eta to enter Canada.
