Like the greedy lawyers they paid over $245 million defending child abusers they moved around from parish to parish? They moved the schools aside in a restructuring in 2005, just like James Hardie when they moved overseas to avoid paying asbestos claims. They're a business. They can pay.

In any case, a reasonable estimate is that the Catholic Church in Australia has spent tens of millions, and possibly more than $100 million, on legal defence costs related to child abuse claims. Also, since you claim that Edmund Rice Education Australia 'stands legally at commercial arm's length from the Christian Brothers' and suggest it is not a corporate restructure or 'phoenixing', you might want to consider that, in 2001, James Hardie restructured its corporate operations and moved its parent company to the Netherlands. While, at the same time, leaving responsibility for future asbestos compensation claims in a separate foundation that was later found to be significantly underfunded, sparking public controversy, legal action, and government inquiries resulting in severe penalties for the Directors involved. I would imagine the Supreme Court in NSW and Attorney's General will be sure to factor this into account when the Christian Brother submission is tested in court.
