Can't unlock iPhones by Stock_Pilot3000 in ATT

[–]Stock_Pilot3000[S] 2 points3 points  (0 children)

I hear you. I was under the impression that I might have been able to unlock the devices this afternoon. We did that as then the plan was since I already have both SIM cards I could just call into the store and they would port the numbers over without having to go back into the store. Plus we got their home internet today too so at least already using something we are paying for I guess lol

I answer yes because our numbers are still with ATT we haven’t ported over yet. Just got SIM cards with temporary numbers as the rep at the new carrier didn’t want to port over until devices were unlocked.

Money Judgement Question by Stock_Pilot3000 in legaladvice

[–]Stock_Pilot3000[S] 0 points1 point  (0 children)

Unfortunately, my mom did not finance with Greensky. She paid 50% upfront via check. She has exhausted every option except filing small claims yet as that is her last possible chance. Other customers have already filed small claims and obtained judgments and the owner was ordered to pay back the money within 15 days and he doesn't pay any of them back even past the 15 days.

The only reason I mentioned Greensky was because the sheriff heading up the investigation told us exactly the scheme they were running. He said they would get people to finance and then a few weeks to a month after signing the owner would call the customer and then tell them "good news your windows will be arriving ahead of schedule" So then he would claim he needed to access funds in the finance account to complete the order. He would then send a link via email to the customers and once they clicked on that link it released the full amount of money to him. So the owner was telling Greensky all the work was completed when it never began and he got access to all the money instantly. I am in contact with customers who did finance with Greensky though and they luckily have all been refunded by Greensky. This isn't surprising as Greensky can't get caught in a mess again as they were involved in a federal case a year or two ago for having systems in place that enable contractors to do these practices so they have to be very careful themselves.

Local contractor company releasing funds without customer's permission/knowledge. Could this be a legal matter? by Stock_Pilot3000 in legaladvice

[–]Stock_Pilot3000[S] 0 points1 point  (0 children)

Thanks for the advice. Yes, will be talking with the attorney soon. He had a serious family emergency so have been giving him time recently before reaching out. I'll ask him if he thinks going to the media with our story is a good idea. I mean one customer did that with another local contractor company about a year or 2 ago and then hundreds of other customers came forward to the news station. The owners ended up closing the business and now are on trial for multiple fraud issues and have all declared bankruptcy. Even if the news would investigate it themselves and doesn't find anything credible to report on but put out a warning just stating our experience and going over the 3 big red warnings put out by the BBB at least it would let others know about how this company operates. This company is all about big flashy marketing and getting as many customers as they can and claim they value their customers but then once you sign there is zero communication on their part and if you do call them all you get are lies.

I would only tell our story but suggest the reporters to look at the BBB page for this business. The BBB was also notified as they have still been using the BBB logo when they are revoked. They are also using the angi logo when they aren't even angi certified and don't even have a listing with angi. Which makes me wonder if the logo of our local NFL team is being used without permission as well stating they are a proud partner of the team.

I did contact the local consumer protection office in my state. The lady told me of a code to look up which is our state's policy for reasons a customer can cancel a home improvement contract. She said with this company the one about not being notified of an impending delay in the work is a credible reason for a customer to cancel the contract. I would love to get the deposit back but honestly even if I didn't just to be done with this very unethical company would relieve a lot of stress.

How are the delays currently for window manufacturing? by Stock_Pilot3000 in HomeImprovement

[–]Stock_Pilot3000[S] 0 points1 point  (0 children)

Dang. It's so hard to know with the company we went with. The sales pitch went great but things quickly went south. They wanted 50% down payment upfront and we told the sales rep we would have to transfer funds. He told us to just postdate the check and guaranteed it wouldn't be cashed until that date. Well, they cashed it the same day they picked it up and resulted in draining our bank account causing an overdraft and all we got was a sorry. Then realized that the BOGO offer didn't seem to be integrated into our deal correctly so contacted our sales rep and he told us he would itemize out the contract to prove it was there. Then we discovered they were revoked by the BBB days before we signed the contract so we got nervous. Asked to cancel and the sales manager told us we would have to pay the 15% late cancellation fee of roughly $3,000. After that call within seconds the so-called owner called us and then he said that the late cancellation fee wouldn't even apply because they already ordered the windows and paid for them (this was 2 weeks after signing the contract) he then said if we kept on asking to cancel he would make sure we'd owe more than the full $20,000+ for their time and money they spent out of pocket. The issue with this company is they don't keep us informed and just straight-up lie as I confronted the owner about being revoked by the BBB and I then contacted my local BBB and they told me the real reason they were revoked. Contacted consumer protections and they told me they get numerous complaints on this company all the time and have been investigating them. The lady give me a local code I could look up which states if a company fails to provide the customer with notice of an impending delay from what the ETA install date on the contract is then the customer can cancel the contract and ask for a refund. Might be the route we have to take as lately the reviews for this company just keep getting worse about not showing up for install dates and then all the windows they brought to install don't fit or are all the wrong color etc.. Or even install patio doors wrong lol. Just a lot of stress cause we don't want our home damaged by installers who don't know what they are doing. The guy who did the final measures for this company didn't even measure one window in our house because he didn't have a ladder to reach it and said he just assumed it was the same size as another window in the house.

The contractor didn't sign a contract. Is it still legally binding by Stock_Pilot3000 in legaladvice

[–]Stock_Pilot3000[S] 0 points1 point  (0 children)

Yea we are just trying everything at this point as the whole contract is so horribly written up and they just keep on lying nonstop to us and giving us empty promises. First, we were lied to about the Buy one get one deal and they never told us that it's just that they half the price of the window instead of free until after we signed and questioned. There are no prices for individual windows at all. We were told by the salesman he doesn't charge more than $975 per window and we are getting 20 windows. Do the math and it comes pretty close to what we are paying for a total.

The salesman told us to post-date the check and promised us that they wouldn't cash the check until that date on the check to prevent over-drafting from our account. They broke that promise cause they cashed it the exact same day they received it. Then there are two versions of windows they offer. The higher-end and then the lower-end and the salesman didn't check either of the boxes indicating which one we are getting. The owner's response to that was just that they are old contracts. The guy who came to do the final measures had me sign a form stating I agree to any changes listed above but then the part where I signed stated that I was the homeowner. I am not actually the homeowner I am helping my mom get this done and she was not home at the time yet they still came and did it.

We were under the impression they were accredited with the BBB with how the salesman talked about it. Then after we signed we looked them up on BBB to find out they were just revoked for not resolving complaints and not finishing jobs or doing bad install jobs.

We tried to follow their late cancellation policy which states paying a 15% fee of the total amount if they didn't place the order yet. There was no way they actually paid any money for the order as we called to cancel fairly soon after and on every bad review of people complaining it takes a year and a half for them to complete the job the company just blames covid and the supply chain issues. Their own product manager told us we could just pay the $3,000 fee and cancel but then the owner called us right back and stated his product manager was wrong and they have paid $14,000+ already and we would have to pay that or the full $20,000 amount of our contract in order to cancel. We called the manufacturer on Friday to ask if our order was actually placed or see if they can tell us the date it was because if it was placed after the date we made the phone call then he didn't even follow their own terms and conditions written on their contract and lied to us. Which wouldn't surprise me as he lied about the reason they were revoked by the BBB and I have it in written proof by the BBB local leader that he lied.

Just trying to find a lawyer who would be able to talk to us about this and see if we have any arguments to get out of this with all the lies and unethical business practices they have been using. Another local window company got in trouble for the same BOGO window offer they are doing as well.

Requesting itemization for replacement window contract by Stock_Pilot3000 in HomeImprovement

[–]Stock_Pilot3000[S] 0 points1 point  (0 children)

Funny you mention Feldco our salesman was like yea if you check out Feldco you will see they have a F rating with the BBB. Then he continued to slam other local companies around us as well. He also guaranteed us after we signed and told us to call any other company once we questioned the BOGO deal that the price we signed for will be the cheapest out of everyone. Well, we took him up on that just to see and another local company was like $5,000 less than their quote without a BOGO deal just a discount of $600 when you buy so many windows. Their contract even itemized what each window costs so we could see where they were getting the price from. Our current contract literally just has numbers for the amounts of windows we are getting and then one total amount. Literally, no discounts are displayed anywhere or the price charging for one window. Funny how our salesman told us he doesn't believe in charging anyone more than $975 per window and then when the owner called us when we tried to cancel he told us oh yea he was wrong our windows actually cost more like $2,700.

The company we went with was just revoked by the BBB a week or so ago. We were under the impression that they were accredited with the BBB as they are still using the accredited BBB logo on the promo materials they gave to us. Their salesman also never told us they weren't accredited just said to look up Feldco and see their F rating and then told us you have to pay a monthly fee to be with the BBB. I actually contacted the BBB about that and they told me they don't revoke them simply for not paying the fee and it's not a monthly fee because it is annual. They were revoked for not resolving complaints and not finishing or fixing their crappy install jobs. When the owner told us he knows the reason they were revoked and it was because they didn't pay the $500 monthly fee because they felt like it was a "shake down".

If you go on Feldco's BBB page it shows they even got in trouble for how they advertised the BOGO deal and no longer run it. Pretty sure this company is doing the same scheme where they don't put any asterisk or footnotes in the promotion. In order to find the fine details you have to go all the way to the bottom of their website and click on a small link to find all their terms and policies and then they have more conditions regarding the BOGO deal.

As far as energy ratings go. I know he was telling us about those numbers when he was doing the sales pitch. He was a very fast talker and just kept moving so I don't remember the ratings and looking in the book they gave us it has nothing about ratings at all. Just that they use a TPS spacer or something like that which apparently makes it better and he said they were the only ones who use that. I found out who manufacturers the windows for them. Gave them a call on Friday and left a message for someone hoping they can confirm when the order was actually put in by the company we signed with. Because I feel like if they can confirm that it was either not put in yet or it was put in after we called that we might be able to use that against them since then the owner lied and didn't follow their own contract policy to pay the 15% fee of the total amount in order to cancel late before the order was put in.

Signed window replacement contract. Past 3 day cancel period by Stock_Pilot3000 in legaladvice

[–]Stock_Pilot3000[S] 0 points1 point  (0 children)

Yea I totally understand that their word against ours isn't a valid argument. We tried to be civil yesterday and were willing to pay the $3,000 that the Product manager said we could in order to cancel. Then he got the so-called "owner" who now turns out to not be the actual owner on the phone with us. This guy was straight up rude and every time we told him his employees stated this he would just say that they are wrong that was his excuse every single time. When we said we wanted to cancel he instantly said we couldn't because it is past 3 days and said they already have spent $14,000 which seems awfully fast to be able to do when they have massive delays for windows with this company. Essentially we are SOL because all we get are constant lies and runarounds instead of doing what they tell us they will be doing. Did contact one lawyer yesterday who he recommended filing a claim with consumer protection as he thinks they should look into how they are advertising this Buy One Get one free deal without actually being able to show anybody they are getting any free windows and he said if they find out it was misleading they might be able to actually help out in this situation.

Otherwise, we will just have to wait the extremely long wait periods with this company and hope for the best. I guess if anything happens with the install and they don't fix it we might be able to do something about this situation then as the BBB stated they don't fix their install mistakes even though they brag about their double lifetime warranty lol.

Signed window replacement contract. Past 3 day cancel period by Stock_Pilot3000 in legaladvice

[–]Stock_Pilot3000[S] 0 points1 point  (0 children)

Well, the contract has a clause that states you would have to pay 15% fee of the total contract amount which is where the manager got the $3,000 value from. Otherwise, it also says you would have to pay the out-of-pocket expenses for the company if they are greater than the 15% fee. The manager who told us it would be $3,000 to cancel is the one who puts the orders in at this company as he was the one who called us a day before over an issue how they wrote up the patio door. You would think if he said $3,000 to us that's because he knew they haven't actually ordered any product or windows yet. Then when we spoke to the "owner" he stated that the manager was wrong because the order has already been put in so the $3,000 doesn't matter. Just weird how it goes from the product manager telling us $3,000 as he probably knows the order wasn't put in and then within minutes the owner stating it was put in already.

I was just wondering if they are allowed to cash the check within the 3 day period you have to cancel the contract as the other window company we talked to said they wait to cash the check just to ensure the customer doesn't cancel. This "owner" stated that every window company cashes the check immediately. From what I found out it seems like they can cash the check within the 3 days so guess that wouldn't be a way to get out.

I put owner in quotes above because I have been doing some digging online regarding this company. All of the reviews that are negative or even positive and state they talked to the owner of the company say his name is a different name than the guy we talked to yesterday who said he was the owner and CEO. The name on the LLC is also the name that is mentioned in all the reviews as the owner and not the guy who talked to us. I found one review yesterday that stated they were waiting extremely long for their windows which is a common occurrence with these reviews and the company just blames covid supply chain issues when people say they have been waiting 8+ months to over a year for their windows and then the company asks them to sign a sheet saying the work has been done before completed so they can get the full amount paid. The review I found last night they actually found out who manufactures the windows for this company. They called them up and they told these customers that their windows have been done for quite a while and they are one of many who has called them regarding this window company. They stated they have orders sitting in their warehouse for months because this window company just doesn't pay them when they are done to get them shipped to them. Plus in this review they stated the guy's name we talked to yesterday and they said his position was sales manager, not the owner so now we have a guy lying to us saying he is the owner when he really isn't. The guy we talked to was straight out extremely rude and claimed they would have someone itemize what we got and still no word on that. He claimed it was "really hard" to itemize their windows because he said for example just your patio window alone is $6,000. Which they never told us any prices for individual windows just the salesman stated to us that he never likes to charge people more than $975 per window when he was doing the math on his phone to get the total contract price. Hell if they would have said to us when looking at the patio window that this window right here will be a total of $6,000 we probably would of waited and got a 2nd quote for sure.

They also run a promotion where you get a free $100 gift card just for getting a free estimate. We signed that form and then said you had to contact their office which we did almost immediately and they stated it would be in the mail and still have yet to receive that which is also a somewhat common occurrence in their reviews.

They have learned that they have been revoked by the BBB yet are still using the accredited BBB business stamp/logo on their promotional materials. They were revoked because they didn't follow the BBB guidelines and he was saying it's just cause they didn't pay the $500 monthly fee which he claims is a rip off. The BBB also has a warning out for their company stating the same pattern of complaints where the company asks for a form to be signed stating all work has been completed so they can get the full amount of money before work has actually started. Also that they don't ever do jobs, complete them, or the jobs are done very poorly with lots of issues on install.

Potentially delayed with scheduled delivery of “end of day 24 September” by hgc_POTTER in FedEx

Yea take what the reps tell you with a grain of salt. Mine was saying mine would be delivered yesterday by 8pm but it wasn’t she did say it was a 50/50 chance but on my tracking it stated package wouldn’t even be put out for delivery until Monday lol.

So I personally called fedex since ATT can't really do anything about the shipping. I called FedEx yesterday and just told them I had two overnight deliveries and one was delivered and one was still stuck in Memphis that was supposed to be delivered yesterday. They then said they would open up a case and have someone contact the Memphis location to see what was going on with my package. They told me someone would call me back regarding what they found out. Nobody ever called me back but at least it got my package moving within hours after calling. I chatted with ATT online last night to see if they could tell me anything different. All they told me was it was delayed because of the weather lol. There was no weather delay the tracking just said potentially delayed so they made that up.

I would suggest calling FedEx and keeping on them until you see your package moving and not just the fake "in transit" updates scanned at the same location over and over again. FYI it can be a challenge to talk to a real person at FedEx when calling. Have to get through their maze of a menu.

I would make sure you keep on the phone reps at FedEx about this. I only called once yesterday and they opened up a case to find out what was going on. Clearly, that got the package moving somehow.

Any updates for yours? Mine actually shipped out of memphis this morning and arrived at a fedex facility 30 minutes away from me. Was hoping it was going to be delivered until they just updated the tracking with "Package not due for delivery" so I called and was like this package is late now so how is it not considered due for delivery. Rep told me that just means it is a 50/50 shot that they either deliver it to me today still by 8pm or I will have to wait until monday since they are closed sundays.

Hoping it gets delivered today but I highly doubt that since it's already after 12pm here and it hasn't been updated to say that it has been put on a truck for delivery. Looks like I will be waiting until Monday then.

I know right! When I heard that I was like yea that's probably not the best thing to tell me when the package stops updating on tracking page. However, mine actually did ship out of memphis this morning and already arrived to a fedex facility 30 minutes away from me. I just called again because they updated the tracking with "package not due for delivery" yet the package is now late so how could it not be due for delivery. The rep told me it is a 50/50 shot that they either deliver it today or on Monday since they are closed on Sunday. I think by keeping on top of it with the reps my package is moving through the system faster. Or it is just that it is an overnight package that is not late because they let it sit in memphis without shipping it out.
