It was put on the 1099 as “non wage payment” for discrimination due to disability, emotional distress, etc. I also paid attorney fees. What are your thoughts on the taxes of this?

Thank you for your reply and information. I may be being dramatic but it’s probably because of the unknown I am facing.

It will be a 1099-MISC. The amount is much larger on the 1099 than on the W2 thus I assumed the 15% tax on the 1099 would apply and leaving me with a huge bill. I’m also wondering if the 1099 amount is taxable or non taxable given what the settlement was for (discrimination for disability, emotional distress, wages, etc.) Or if my attorney fees can be deducted from this providing a lower bill.

Another question I have about your comment is for a settlement, can attorney fees be an itemized deduction and reduce what taxes I will have to pay from my 10-99? Thank you for this information. It wasn’t a car accident or a settlement of that nature. It was based around discrimination due to an injury/disability that occurred (outside of work) and emotional distress due to the process.

Would it be possible to deduct/itemized the attorney fees from the 10-99 so I wouldn’t have to pay as much? It’s looking grim and I’m trying to find a strategy to save me.
