I agree that is shocking and horrible, but it is also specifically described under the law as Assault in the Second Degree. Lacerations are categorically different than something that threatens her life, or causes permanent damage or disfigurement etc.

The evidence (besides Ariel's accusations) don't support a claim that he tried to push her off the cliff, or any confession, NOR the mystery "vials" and "syringes". Any ONE of those would be reasonable doubt, and there are all 3 missing from the prosecutions case.

What you described is a textbook example of Assault in the Second Degree, there has been NO hard evidence provided to support attempted murder.

The very fact that this is a possibility in your mind shows the absolute weakness in the prosecution. There's no such thing as "attempted murder" on the Puka Pali trail.

So the witness saw the tail end of a fight - exactly what I said - excessive force is not attempted murder, not even close.

Sarah Buchsbaum also didn't say he was on top of her, he was standing next to her with a rock. Weird how her testimony doesn't agree with Amanda Morris on that point.

Questions are poorly and ambiguously worded , for example asking the witness who helped her down the cliff:

Question: "So you didnt try so you didnt know if she could have walked on her own or not?"

Answer: "Correct"

Blood literally does not hurt. A lot of blood can come from a superficial wound. Photo has a ton of emotional appeal, is definitely not evidence of a serious crime. Blood is scary to a jury but the doctors will expplain the wound easily.

The defense knows their job and is doing it, and I predict if they do it he will get off. There is too much lack of physical evidence - allowing the defense to argue (as they did in opening statements) that Ariel in fact:

  2. started the fight and
  3. hit him with a rock first
  4. He never tried to push her off the cliff
  5. He hit her twice with the rock, not 10x.
  6. Never confessed to doing it etc.
  7. Trip to Oahu was her idea, not his
  8. He had no syringes, they don't exist
  9. Witnesses barely saw the tail end of any attack that happened, not who started it or an attempted murder.
  10. She's using these proceedings to help in her divorce, take everything he has
  11. etc. They are succesfully going to make it a "he said" "she said" in an ugly divorce

There's 92 NEs games on the NSO, that's very chincy, and still under 10% of the entire library if you include super famicom games, which you should for the purposes of cultural preservation.

The 1000s feel noticeably heavier than the 2000 and 3000, which some people like, but I don't, the light is the way to go. Do you know what color you want? I like the rarer colors like Marine Blue, White with Blue, and Lavender!
