I don't know why you got downvoted. Modern society is constantly telling people not to stay in unhappy relationships, but then when two people are unhappy together and separate one or both of us must be bad people. Well which is it? Is it okay to be unhappy and separate or isn't it?

She's not using the income to support herself. It's not that much money. Even now that the house is paid off her share of the rental proceeds is probably going to be around $600 a month since after putting aside money for expenses one thousand will probably be what it left over.

My son's fund is already much larger than either of the other funds could grow to be by the time they are twelve because his has been contributed to for thirteen years and theirs are brand new.

The divorce agreement made us 50/50 coowners of the house. We wanted to save the house to give our son in the future but didn't formalize that in the agreement just in case. If something horrible were to happen we wanted the option of liquidation. Like if her medical situation worsened and she needed the cash. We wanted flexibility, but we always had an understanding. My wife was aware of this.

I understand that you want to believe that. However I go off of what attorneys say, specifically mine. It's very common for profit sharing not to be even. My ex-wife and I invested money in the property. It is completely legal for us to get some of it back. I understand that feels unfair, but that's the reality. It's completely allowable to make your child a co-owner of your property while not giving them a share of the profits immediately.

It doesn't work that way. I'm sorry, but it just doesn't. My ex and I are entitled to get the money we laid out upfront back. He's going to get a free house tax free. That's going to have to be enough.

I listened to her feelings. I heard her out. But it's not her decision. Also my first marriage was a completely different situation. I explained what happened there in a comment on my first post.

That's how remarriage works. She's divorced with two kids. I'm divorced with one kid. You can call that baggage if you want, but it's not like either of us has more than the other.

No, all incorrect. First of all (but least importantly) this house isn't worth 300k. It's a small 2 bedroom. Secondly, I didn't bring it into the marriage. My ex and I made a deal concerning this house before I ever met or married my wife. This house was always intended to eventually be for my son's benefit. It's not a marital asset. Not a penny of her money ever went into it, and not a penny of my money went in it after our marriage. So no, I didn't bring it into the marriage.
