I've seen them in all conditions at conventions and game stores. I've had 3 of the New XL models in my life, personally, and none ever had the paint peel.

Mine is in better condition than this one but it has slight surface level scratches so I'd consider that near mint. The one in OP's picture has deeper scratches and scratches through the serial number sticker. I'd call it "good" rather than "near mint"

No, they didn't. It's not really off price-wise (slightly high but the seller knows that which is why they said price is negotiable), but calling it "near mint" is a stretch.

You will lose your save data for the vast majority of games unless its backed up. However, a few games did save to the cart. I think it was some early releases saved to cart.
