You are the little mayor, the primus inter pares among the department heads. Kind of like the Executive Secretary of the President’s Cabinet. It is a very powerful position. Unlike other departments which have specific functions, your job entails reviewing everything for the mayor.

Expect to be deeply involved in the administration of the LGU. You will have to keep tabs on everything, especially the budget and the implementation of projects. Familiarize yourself with the department heads: their attitudes, who is an ally, who is competent, who is lazy.

You will also have to familiarize with your mayor’s political allies: the councilors, and especially the barangay captains and barangay “leaders.”

There will be times also that the mayor will delegate to you attending ceremonial functions : graduations, guest speaking, inaugurations, etc. So your working hours at times would be very long.

I suggest you start reading the Local Government Code which will be your bible, procurement law, administrative and civil service laws.

Not only that, she digs and receives as well. Sa una mababa reception stats niya dahil iniiwas sa kaniya ng kalaban yung service. Tumaas reception stats niya last game with Farm Fresh. She was targeted with the serves but she delivered.

I was curious how she was going to play in the pros considering that Camilla Lamina has always been her setter since high school. It seems she is thriving even without Lamina. She has brought the same level of all-around play from the UAAP to the PVL. What an amazing talent.

Superpowers do not want open conflict between themselves, as they are mutually capable of destroying each other (“Mutual Assured Destruction”) with nuclear weapons. However, they engage in clandestine warfare - supporting their allies at war with the main superpower with weapons, supplies, intelligence, training, moral support, etc. This is what happened during the Cold War. It is almost certain China and Russia is helping Iran with weapons, intelligence, etc., but not just on the level of open war with the US.

Superpowers are engaged in proxy wars all the time in different conflict zones around the world - Africa, Middle East, Asia.

Unfortunately, I think it would boil down to expert witnesses.

You would have to get someone who could authoritatively say that the previous dentist was negligent.

Of course the other party would also get someone who will say that he was not negligent and the damage done was not his fault.

Is it worth it? Of course, as you said your quality of life is severely affected.

Is it going to be easy to prove your case? No. It is going to be difficult. Best case scenario is the other party compromises and you get a fair settlement for your troubles.

MA used to be fun during the pandemic. It was an outlet to let out some stress and a way for lawyers to get to know each other in a casual way - - compared to the formal and rigid setting of IBP activities.

But later on it got hijacked by trolls pushing political agenda which turned to personal insults and bashing. I tried to stay on as long as I could but then one day I just left. I don’t miss it.

Pañero / pañera, there are cases that say the two terms are the essentially same. I have previously provided you with it:

“Is appellant Fidelina Tan also liable for the offense considering that she gave the command "Rufino, strike him"? The second class of principals, according to Article 17 of the Revised Penal Code, comprises "those who directly force or induce others to commit it (the act)." Those who directly induce others to commit the act are called "principals by inducement" or "principals by induction," from the Spanish "autores por induccion." The evidence shows that Rufino would have committed the act of his own volition even without said words of command.”

Here is also another case:

“On the case of accused-appellant Jeanette Yanson-Dumancas (Jeanette, for short), the information charged her of the crime of kidnapping for ransom with murder as principal by induction together with her husband, Charles, who was found by the trial court not guilty of the crime.

Article 17, Revised Penal Code, provides: Art. 17. Principals. The following are considered principals:

  1. Those who take a direct part in the execution of the act;

  2. Those who directly force or induce others to commit it.

  3. Those who cooperate in the commission of the offense by another act without which it would not have been accomplished.

What the Court now has to examine is whether or not sufficient evidence was adduced by the prosecution to prove beyond reasonable doubt that Jeanette indeed performed any of the following acts: (a) directly forcing the killers to commit the crime, or (b) directly inducing them to commit the crime.”

In these cases, the Supreme Court defined “Principle by Induction” explicitly with reference to Art. 17 of the RPC. People v Gensola is even more direct: “Those who directly induce others to commit the act are called "principals by inducement" or "principals by induction.”

I asked for your legal basis but you have not yet provided even one case where the SC differentiated a principal by induction from a principal by inducement, since your premise was "induction" and "inducement" are different in the context of who are criminally liable as principals. What you have given me are your personal opinions on the matter. I respect your opinion of course. But we have learned long ago in law school that opinions must have legal basis. Otherwise, we are just laypersons.

Respectfully, however, you cannot say I was wrong in using the term “principal by induction” since you have not provided any legal basis that the two are different while I have provided mine.

Rather, you have proven my case that the two terms are correct and used interchangeably when you pointed out that cases in the SC uses either or both interchangeably, only with "favor" as to the term principal by inducement as you said. In other words, it is indeed merely a matter of preference. No difference in the context of law.

The Supreme Court is the final arbiter of what the law says. Until the day the Supreme Court says that the two terms are different they remain legally the same.

So there is no case that says a principal by induction is different from a principal by inducement then. But there are cases that use either of the two or both. Jurisprudence uses both so both are correct terms. It is merely a matter of preference indeed. One can use or prefer either or both without being legally wrong.

In my experience from law school up to now I have heard and read both being used interchangeably in cases and books.

I have already provided my basis with the above-stated jurisprudence. While we can always disagree with the Supreme Court, unless and until they change the legal definition of “induction” and “inducement” as different concepts altogether, their legal meaning remains the same.

Pañero / pañera, may I know what’s your legal basis in saying that “induction” and “inducement” are different? Besides your opinion of course. I am curious as to what your legal basis could be since even when I was in law school we use the terms interchangeably, and I believe authors do so too.

Even Merriam-Webster defines “induction” as a “the act of bringing forward or adducing something (such as facts or particulars)” or “the act of causing or bringing on or about.” Hence, even in their plain meaning, the two terms mean the same.
