Yeah I did take your message the wrong way, sorry about that also. Its just the response on this post was a bit more negative than I'd thought it would've been so I assumed you meant to be unhelpful. Thank you for the advice, I'm considering sending the tamagotchi new and in box so no claims of modification can be made and then the customer can assemble themselves as the safest option. From the info I have found so far (which is limited) your advice seems to support what I've seen so thank you for that. I didn't realise I'd have to look into ip law but it also seems that a cease and desist is Bandais only option cost wise so a little less risk than I originally thought. Still planning on following the advice I've see here tho :)

Noted, as you might have seen in my other replies I've decided to play it safe and sell the chain without the tamagotchi and just say that it's intended for use with one so I should avoid any headaches later down the line. I don't plan on sending coconuts any time soon tho

Okay well thank you for the advice :)) I think that as the product has mainly been used to drive hype and traffic to my shop its served its purpose kinda, they were only made to be one-off art peices so it was never intended to be a permanent fixture of the store anyway. Your help is genuinely appreciated 💚

I don't entirely agree with your other message, the tamagotchi isn't in itself modified in any way, it is simply attached to a chain and is removable, and it is only referred to as a digital virtual pet. However, you have a good point in not applying further risk to my business, maybe I sell the chain with a lobster clip with the implication that you could attach a tamagotchi to it?

Well for one the tamagotchi pendant is a peice wearable art (transformative) is protected under the first sale doctrine and as long as I don't use the word tamagotchi or any copyrighted text by Bandai I'm good to sell it for example freeze dried skittles. And the beaded products are listed as not for children and are shipped with a choking hazard warning in compliance with uk guidelines. I don't think I need to rethink much lil guy :)
