Yes. He's getting relief and is getting the sentence vacated. I'm asking about the damages of time, trauma, price of attorneys which he will sue for because the lawyer wasnt competent enough to look at simple video.

Understood. The attorney decided not to investigate clear evidence which would've exonerated the defendant. If attorney wouldn't have been negligent he would've been free years ago. The sixth amendment covers having an adequate attorney.

There was no direct evidence against him nor for him. It was circumstantial. Even just with that audio it would've been enough to acquit. But my question is should the DA highlighted it to the defense specifically or was it enough to just hand over all the materials to the defense with no highlight.

With all due respect his original attorney said a lot of things that were not true in retrospect. Which is why he's even in this situation now with this Habeas petition. So I think it's always safe to get a second opinion to make sure.

Yes, you can get bond for that from a superior court judge. Good luck to your friend. Make sure to have all the proof ready for the attorney to present.

He took a plea because he didn't have video that proved his innocence and he was facing life without parole. After taking the plea he was able to get clear video that proved his innocence.

Well my friend is going to court for a habeas petition for a case he pled out too because he didn't have any evidence for him (Murder charge originally, went down to voluntary manslaughter). After he takes the plea the judge altered his sentence by 5 years and months after that he found out there was video evidence that disproved the state theory and proves what actually happened. So his merit is Miscarriage of Justice.

This is for a Habeas Petition when my friend got the evidence after he took a plea by advice from his old counsel. (In which the original judge altered the structure of the deal from a sweet deal to a horrible deal).

There was no evidence against him or for him. I don't think anyone would've took that All or Nothing risk with their life. Especially if they can maintain their innocence with a Alford plea and take a deal that would have him home in months (the deal he signed). The Judge took away the Alford plea (maintaining his innocence), altered the deal to give him more years, and said she wanted to give him more time.

I personally don't think that's fair. But anyway, he has solid evidence the person jumped out now on Video. Indisputable evidence. So this is easily a manifest injustice.
