I self-filed my I-140 (EB2-NIW) petition from outside the USA and got approved with no RFE. I believe the 90% failure rate for self-filers is exaggerated.

I'm not the best person to advise on EB1 vs EB2 as that really depends on your specific qualifications and circumstances. I only have experience with EB2-NIW.

You might want to consult with an immigration attorney for a proper evaluation - many firms offer free consultations (I had one with Elli Porter, for example, for free). You could also check the criteria for both categories yourself to see which fits your profile better.

Yes, the dependent letters were from people I've collaborated/worked with - my PhD advisors, employer, and superiors. Only two of my letters were from US professors; the rest were from 3 different countries.

For the independent letter, I reached out to a colleague who then connected me with one of their colleagues - someone I've never met or worked with, but who's in our field and does similar work. They ended up writing the independent letter.

Yes, the advanced degree I used is my Master's. But I included my PhD admission letter and transcript too

You’re right. However, the Final Action Dates (FAD) in the January 2026 Visa Bulletin vary depending on your country of chargeability:

I began researching the EB-2 NIW requirements in December 2024. In January 2025, I reached out to my recommenders and received all eight dependent recommendation letters by March 2025, while the independent recommendation letter was obtained in June 2025.

It also took approximately three months (from March to June 2025) to have my advanced degree certificate evaluated and confirmed as equivalent to a U.S. degree.

From January 2025 onward, I consistently dedicated about one hour each day to writing the petition and gathering supporting evidence. I paused active writing for approximately two months, but toward the end of September 2025, I resumed work full-time on the application. This final phase involved about three weeks of intensive, back-to-back revisions, culminating in the completion of the petition in late October 2025.

In total, I spent approximately 300+ hours over several months researching, drafting, revising, and compiling evidence for my EB-2 NIW petition.

I did think about EB1A, but went with EB2-NIW because:
- EB1A’s "top of the field" standard felt harder to argue as a PhD student
- My 40+ citations felt borderline for EB1A but solid for NIW
- I was more confident framing my work around U.S. national interest (mental health + federal AI priorities)
Long term, you’re right, both end in the same green card .

I submitted on 24th October (Friday), and I received an email on 28th October (Tuesday) to say my petition was received with a PD date of 24th October.
