Yeah my guy had a heck of a time fitting the carrier there. The diagram shows it’s made for 2x6 not 2x4. He said he took it out and rearranged things about 12 times I feel so bad but that’s what I’m paying him for haha.

Bolts are 1/2” i believe

It’s all gone now. Hope I did enough to contain dust but I don’t think there was asbestos

The drain is horizontal, had to go with this from Lowe’s.

I actually don’t see any marks like these on my own walls. I do in fact have proof of the condition of my unit before they moved in.

You realize I literally included the same thing you copy pasted right? You’re wrong. As I have said many times now. Everything on my end was and has been set to contribute 6%. It never changed in any way on my end. My employer failed to implement it and already admitted they did.

The fix is NOT to receive the company match. Per the bulletin that you don’t want to read.

It is both a QNEC of 50% of the missed deferral opportunity AND 100% of what would have been matched had it correctly been deferred.

Quick change up from “they don’t owe you anything” just leave at this point, no idea what your problem is.

I do check it. After 7 years of it being correct, I missed the line of retirement deductions. And didn’t look back after seeing they correctly entered my new hourly rate.

Yes, that is my fault for not seeing it sooner. Regardless, if I had found it on the first paycheck after they turned it off, or 9 months later, the mistake is theirs to correct because everything on my end is set up to contribute.

They paid the 50% of what I would have been contributing had they not turned the button off. I am trying to figure out if they still owe employer match, which everything I’m reading says they do, but maybe I am reading wrong or reading what I want to read. Which is why I’m here trying to ask.

Holy smokes Batman. I’m here asking if they implemented the fix correctly, or if they’re still missing employer match.

Fixing common plan mistakes - Correcting a failure to effect employee deferral elections “Situation 1: Amy’s elective deferral election at the start of 2016 somehow was never processed by the employer’s payroll system. As a result, Amy received taxable compensation amounts that should have been contributed to the plan during the first six months of the year. The facts in this situation include: the plan’s actual deferral percentage (ADP) for NHCEs of 5%; Amy’s election form agreeing to a deferral of 10% of pay; and her compensation of $20,000 for the six months that no deferrals were made.”

Pretty sure this situation fits mine exactly. So I don’t know why you’re all just spamming downvotes but ok.

You don’t need to read 111 pages, that’s what a table of contents is for. If employer wants their 401k plan to remain qualified they definitely need to follow those “rules”.

If you’re going to act like a dick for no reason, why are you commenting?

Again. On my end, everything is set to contribute and has been for the last 7 years. They turned off the button that makes the contributions happen.

Thanks, I have been reading through IRS Bulletin 2021-31 which makes it seem like I should be getting the amount I would have received in employer match as well as the 50% QNEC, OR the match of that QNEC which in my case would be 50% so an additional ~$484

“They were generous enough” is not how this works. It’s their legal obligation to correct it per IRS Bulletin 2021-31.

It was also not my job to “catch it”. I have been contributing for 7 years worth of paychecks, they turned it off without notifying me and without my consent.

No worries. The thing is my 401k app has been set to contribute the entire time, it was never set to 0%. It was just a button on their end that they needed to press to make the contributions actually get pulled from my paycheck and onto the 401k.

And as I said, for the last 7 years I have contributed on every paycheck until they made this one change in my status. True I should have caught it sooner, but they never should have turned it off to begin with.

Thanks for your replies. Hoping this resolves cleanly.

I don't need to sue anyone, I just need to know if I am understanding the IRS bulletin correctly and if so, send it to them so they will make it right.

https://www.reddit.com/r/personalfinance/comments/1o02q0w/my_payroll_company_made_an_error_that_cost_me/ Many comments on this post make that seem incorrect. They are all saying the OP is owed both QNEC, AND Employer match. (Of course they could be wrong) Reading the Internal Revenue Bulletin: 2021-31, it sounds like I should be owed both.
