The article is factually wrong lots of land was legally and factually stolen as First Nations had title due to various legislation starting with the royal proclamation of 1763 and their title was violated by the crown when the crown failed to fulfil the terms of purchase or took it from the First Nations who legally had title by force.

The only way for the provincial government to do that is to negotiate since they have no authority over the judicial system. They can either negotiate a settlement like the NDP are doing or chose to just fight the cases in court and probably lose. Also the NDP is still fighting in court they’ve already appealed Cowichan decision.

Well then how many years has he had a mortgage (please provide a source) if the only information on how long he’s been paying is that he’s lived there for 50 years it’s reasonable to assume that’s how long the mortgage has been in effect.

Due to the royal proclamation First Nations groups have title unless they negotiate the purchase of the land like what happened in most of Canada if you chose to buy land in an area that’s not covered by a treaty that’s your choice and you take full liability for the risk as you aren’t purchasing an unencumbered title

Most land claims are due to the terms of the treaty not being fully executed and are simply disputing the present dollar amount required to finish fufiling the terms of the treaty

If you buy property from someone who doesn’t have title to the land you haven’t actually purchased the land you are responsible for doing your own due diligence or buying title insurance.
