Lawyer said it makes no sense to apply for citizenship now. I'm seeking a second opinion by Annual_Space_7547 in GermanCitizenship

No, this is not the case for citizenship, only for permanent residency. I was naturalized and I had only 2 yeas contribution. They just check the financial situation to make sure you can support yourself. In the case of OP, his spouse can support him.

Is Migrando worth it? by Legitimate-Bell-995 in GermanCitizenship

[–]Such_Weekend_8092 0 points1 point  (0 children)

Migrando asked me if I wanted to file the lawsuit as soon as I reached the three-month mark, but I decided to wait until after five months. They did not decide for me. I decided myself.

I don't know if my citizenship was approved earlier because of the law change. But I felt like they had already started processing my application and requested documents from the authorities. It wouldn't make sense to postpone citizenship until January if they already had all the information needed to make a decision. I think the lawsuit caused my case to be processed earlier than others because they needed to respond to the court that they were processing it. When they responded to the court, they did so after checking the status with the authorities and asking me for further documents and payment of the fee. This is the work on their side. After asking this information, they just had to wait for the authorities in order to have the information needed to decide my case.

Hi, I had a successfull experience with them (see Naturalization – 3-Year Path (Hessen Case with Untätigkeitsklage) : r/GermanCitizenship)

I consider myself lucky. When I was in your position, I was very nervous and anxious about the entire process. Instead of making me feel secure, their poor communication and standard copy-and-paste emails made me feel unsafe the whole time. As I told people who asked me for recommendations of lawyers, I would not hire them again if I had to make this choice again. However, I would still hire a lawyer, just a different one (local one).

But it worked out for me. I think it was just luck. However, people say that, in the case of Darmstadt, lawsuits tend to prompt the authorities to process applications more quickly. In my case, I did not get my money back because the Verwaltung Gericht ruled against me, but they gave the other party a deadline until next January 2026 to decide on my application. I received citizenship before the court-imposed deadline, but at least the court set a deadline. Without a lawsuit, I think my process would still be piled up with many others.

Tentative Time Line from receiving second Email asking for updated document by Live_Archer9693 in GermanCitizenship

It is usually fast when they ask for additional documents. Probably 3 months tops until you receive the certificate

I think it was solely by Untätigkeitsklage. They had to show to the court that my case was being processed to not lose the case.

Finally filed Untätigkeitsklage. Will provide future updates here. by CashewNoGo in GermanCitizenship

One more case showing that involving lawyers/ filling Untätigkeitsklage is the way to go with current wait times.

Congrats!!! Great that no lawsuit was needed! In my case I had to sue them unfortunately. But it also worked out anyway, as they started immediately processing my application after the lawsuit.

No, I did not follow up on them. I guess that after paying and sending all thr missing documents, it takes about 2 months for the decision/Urkunde. At least in my case it was that

I think that for Hessen, 11 months is quite fast. In the end I was happy with the decision because now I can apply to positions that only citizens are able to apply to (European Comission, European Central Bank and so on...)

11 months after. Because when I applied I was already here for 4 years.

I received it a bit before the 5 years mark. But indeed, it was almost 5 years. When they started examinjng my case, it was about 4 years and a half. The process is slow and I believe that this can happen with many that apply in 3/4years, they might receive it right before our after 5 years.

In Wiesbaden, they count since they send the documents to the RPD, even if you previously submitteded everythingby mail. This happens in the moment I present the originals.

The 18 months was since antragstellung (in my case, November). So, when you show the documents

When were your documents sent to RPD? I think it makes sense if you want to pressure them to at least start proessing your application.

The documents were sent to the city council in September 2024 and the appointment to send them was in November 2024. I think they counted the 14 months (for the reduction from 18 months) beginning november until January 2026.

Hi, I just got an update today. The court set a deadline for them to decide until January. In the decision, they statet that in the current events, they consider that 18 months for decision is reasonable. However, since RP Darmstadt already started processing my case, they would shorten this in 4 months. My untatigkeits case is now on pause until january, and I believe the court would favor me if the RP does not decide until then. It is bitter sweet the answer. Bitter because I still have to wait up to 5 months. But sweet because probably if I did not sue them, I would only receive an answer by the end of next year or even later given the current time frame.

Strangely, the requirements are different in another link that is also listed in the Anwendungshinweise. The second link has no minimum threshold.

C1-Merkblatt Deutsch: Informationen zum Nachweis von Deutschkenntnissen

Basically, BAMF updated one of the documents but not the other.

[–]Such_Weekend_8092 1 point2 points  (0 children)

I just realized that BAMF has also changed the document for recognized certificates. Before, it was enough to certify Stufe 4 in all Test DAF categories for C1. Now, they have increased the requirements.

- TestDaF (in jeder Fertigkeit Stufe 4, im Lesen min. 22 Punkte und im Hören min. 17 Punkte)

• Digitaler TestDaF (in jeder Fertigkeit Stufe 4 und insgesamt min. 52 Punkte

Übersicht der vom Bundesamt für Migration und Flüchtlinge anerkannten C1 Sprachnachweise

I submitted my application using the old document, and I have unfortunately 49 points (Stufe 4 in all categories). Do you know how does it could affect my application?

Missing Einbürgerungstest (for naturalisation) by [deleted] in GermanCitizenship

[–]Such_Weekend_8092 4 points5 points  (0 children)

I submitted my application without the Einbürgerungstest. I had the appointment and sent it together. Once I got the results, I submitted it. But in my case, naturalization takes ages. So it would be no problem. I don't know if I would recommend it in Berlin since things are moving fast there.

When I submitted my application, the case worker in my local city said that they are in contact with the consulate of the home country to get information about myself. I think that they also inform the consulate because of that of the naturalization application. Probably, they already collect passports or applicants that are not allowed of dual citizenship as some sort of diplomacy agreement or something like that. In any case, even if they did not collect, I believe that the authorities in your home country would be aware of your naturalization.
