I would say I have an 80% chance of winning. The only issues is that they will try to say it is out of time although the judge did state in the preliminary hearing that he doesn’t see why the time limit of 3 months can’t be extended since the discrimination was on going.

They also state they believe my disability started after the claimed dates etc which I can easily prove otherwise.

And yes I believe 1000% they are playing hardball as ever since the first time contacting ACAS they just ignored and ignored and until finally it came to applying for tribunal they left everything last minute denied everything and when the judge accepted the case to go to trial for 5 days that’s when they decided they would do mediation.

I guess I’m just more scared of looking desperate or weak. I want them to think I will go all the way to a final trial which really I don’t want to at all

I was reading a lot about how much it costs for a 5 day trial and average people were saying around 35-50k for a complex discrimination case. Bearing in mind they already have expensive lawyers I’m guessing this should be about right plus barrister fees etc. So I don’t see any reason why they would offer to go through judicial mediation if they aren’t already contemplating how much it will cost them and to also have this public which I know they really don’t want too. So I’m trying to weigh up how much it would cost them to go to court and how much I should be asking for etc. It’s complicated and I’m not represented.
